let's take up a collection for a giant box of Kleenex so Matt can dry up his tears....stop whining...YOU broke the law, not INS,not NCIS,not the lawyers (well, maybe some)....you did this to yourself - and no one on this site can change that - and probably even few would even if they could. You were all set to scam your way in the US some time ago....but you got caught.....oh well...

1 sentence: "ENGLISH MOTHA ****A, YOU SPEAK IT?" 2nd sentence: "You want cheese with it?" Ok, all kidding aside, Matt need to understand there's nothing to be done at this point. You're banned for life. There's no upoint coming to this board and complained, I doubt there's anyone here thats a senator or congresman. You can take your plight with your wife's local statesman and see if they can initiate a proposal or something. Other than that, you're just wasting your time whining and *****ing, which is fine if thats all you ever wanted i guess. ps: you invoke god's name and love soo many times, yet you have no problem asking god to condemn someone12 to a horible situation. What kind of hypocrites are you?

Dear Matt: why don't you just call god directly and ask him/her to do just that? I am sure that operators are standing by to take your call.......and while you are chatting, why not ask an additional favor and have that same deity teleport you back to America?

Matt: you cannot get a waiver because our laws do not allow one to be available....under INA 212 A 6 C (ii), Congress did NOT make a waiver available to any alien relative of a USC spouse/child/parent. Therefore, an attorney cannot help you obtain something that is not available.

Has it ever occured to you that no suggestion has been giving simply because there's no way around it?? If you want to waste $$$ and contact a lawyer , feel free to do so. Joe shutersman (http://www.shusterman.com/) and Sheela Murthy (http://www.murthy.com/index.html) are some of the best out there. Why don't you contact them and see if there's any way out. Maybe your wife can get suggestion too to find a good local lawyer.

Before somebody starts nit-picking me, yes, there is a waiver for a NON IMMIGRANT waiver under I think 212 d 3 A - however, most non immigrant visa applicants have to prove that they will LEAVE the US after a visit....with a USC spouse and kids, that is not likely - in other words, you have to qualify first for the tourist visa, and only then could you ask for a waiver - but not for an immigrant visa - there is NO provision for a waiver for an immigrant visa. I'd say your chances are virtually zero.

Matt: I cannot speak for everyone, but I think that "hate every immigrant" is too strong. First, we are really talking about illegal immigrants (though I imagine many who are legal now were not earlier)....and the fact that what a lot of Americans do not like is people who ignore or violate our laws, then expect instant forgiveness and a green card....that is not the way this country works (generally). We have laws, rules, and penalties for those laws and rules if people violate them. That's what civilized countries do - try to balance out the needs of society and the country. Some violations have more severe consequences than others - plain fact. In your case, you were probably already in the US illegally, left it and then tried a scam when you were returning. Now, you may try to tell me you were legal, but if so, then why didn't your USC wife file the necessary papers, etc to get you a GC? Let me guess....you were here without authorization (inspection, perhaps)...perhaps crossed the border without a visa...and therefore could not change status. Now please do not tell me about how all of this is a) unfair and b) not your fault......what would you say to those who are outside the US, waiting patiently and honestly for their turn to immigrate to the US (based on valid applications)....that you are special and deserve a GC faster because you were illegal and broke the law? That thought is not logical nor realistic. The bottom line: knowing the penalties could be severe, you decided to try a scam anyway (and had already successfully entered the US before) and were apprehended.....game over.

Matt: So,....had you returned to your country after a few weeks (as you told our embassy) you would not have a problem. Instead, you stayed and then tried a change of status....and stayed...and then, somebody you did not know "told you" to go to Canada to get married and you, like some kind of idiot, took this person's advice.....and as usual, like most illegals or those who have been deported or denied admission or whatever, want to blame the mystery people who "told" them to do something.....so if this "mystery advisor" told you to jump OFF Niagra Falls, would you have done so? Or told you to stand of in front of a speeding train, would you have done that too? And, after your apparent denial of status change or extension, you (not the mystery person) did not leave the US as required....so once again, who is to blame? You. All you had to do was do what you said when you got the visa in the first place.
