JF - Your information is incorrect. She is an asylee. She has a right to stay here whether or not she can adjust status based on her asylee status. She absolutely does not have to leave the country to adjust status based on a marriage to an LPR. Only if she were out of status would she have to leave the country to adjust.

in order for her to adjust the spouse needs to be a USC.

ok let me make it simpler. For example, She was admitted and withdraws her asylee app. marries, the spouse is an LPR, she cannot adjust, he must be a USC in order for her to adjust.

Oh, you have the facts confused. She has already been granted asylum as a derivative of her father. She does not lose that status even if she gets married. But if she marries she cannot adjust because she is no longer the "child" of the primary asylee. It sounds ridiculous but that is the way it works.

So she is still an asylee and therefore is still in status and does not need to leave the country to adjust, even if only married to an LPR.

You should wait for your I-485 based on Asylum gets approved. There is no point in applying through your husband since he is only a green card holder and not a United States citizen.

Spouses of green card holders have to wait until an immigration visa is available and only then they can apply for I-485.

Even if your husband was a USC, you are better off than re-filing paying fees again for a benefit you will receive shortly anyway based on your I-485 based on asylum.

What is the big rush anyway, you are allowed to work legally in the United States, have a social security number, and can travel outside of the US by requesting a travel permit.

AMANDITA1981 - You should post this as your own message.

But to answer you in short. You cannot really get around the I-864. However, anyone can be a sponsor, which means that if you don't have the means to support your husband, then you need to find someone who does have the means to file an affidavit of support for him. It's better if it is either your or his family member or maybe his boss.

Work authorization just means that you can work in the U.S., at any job you can find. A work visa is normally for a specific job. They are completely different.

How the sistem workes if I am 21 and the I-485./based on my father Asylum status/ started from my father, when I was a minor is pending ?
