Well, if you've read my other posts, I've finally straightened out the situation with my Brazilian boyfriend.

Although he flew into Arizona from Mexico, he says it was on a small like 10 person plane, and when he landed he was not at a regular airport. No one checked his passport. I assume it was someone who owns their own plane and landing strip. He says he never applied for a tourist visa. Frown He also gave me his passport to look at again, and the only thing in there is a stamp for when he flew from Brazil to Mexico.

I realize now that this is a very different situation from him just overstaying a tourist visa.

What would happen in the future if he stayed in the USA and we wanted to get married?

Also, what if we wanted to live together. Can a USC get in trouble with the law if they live with an illegal immigrant? I just want to make sure I know exactly what I'm getting myself into.

Thanks for any information you can give me on my situation!

Orion13: This loser lied to you. You thought that he came to America on a tourist visa and decided on a whim just to stay in the country.

Well, now you know that he planned to enter illegally all along. He flew on a small plane into some airstrip...and what else was on the plane??? I doubt that this is all as innocent as you believe.

Who knows what you're getting yourself into. There is no way that this liar can remain in America and become legal. Even if he applies at the American Embassy in Brazil, I can just see the response when they discover that he entered the country on a small plane piloted by human smugglers and most likely importers of illegal and controlled substances.

Continue this at your peril.

Hi Orion I remember you

There is no law dictating whom you married.

Again like I told you before you have to ask yourself if you wanna do it.

Its a road most travel to, Your bf have to go back in Brazil and get the 10 year barr to get back on the line. You can file a petition for him and file a waiver ( this applies for the USC
claiming extreme hardship with the absence of the alien ) You can PM Mike or 4now or Hudson for the info. and of course a legal advice from a lawyer.

Or if you really love this guy and not ready
to marry him... you can move with him in Brazil
while waiting for the barr.

on top of all that, He has to do it legally
or you both gonna be miserable with him being here in ilegal status. ( can't drive, cant work etc. you know what I mean)

Unfortunately his choice to enter without inspection means that the only option for him to become legal is as Speed said. He would have to return to Brazil and you can then file an I-130 for him.

He'll go through the process as usual, right up to the point of the interview at the Consulate where he'll be denied because of the 10 year ban. At that point, he'll be eligible to file an I-601 waiver, which the day if he has it prepared and has the fee. Basically, the waiver will have to prove extreme hardship should you be unable to join him in his country. What constitutes hardship is fairly broad, but because it's such an important thing, I'd recommend using an experienced lawyer to help with it.

There's quite a good article on the waiver process here.

Just a thought... And I dont know if this will work but...has he any paper work from the flight he took from Mexico to Arizona, he must have something, a receipt, etc., if he has that, he may want to ask USCIS if this could be used as sufficient evidence of how he gained entry into the US legally.

My apologies for not reading correctly,

Although, Any planes leaving from another country should file a flight plan, and the receiving airport should have governing bodies that are responsible to check the plane that is landing - is this not so?

If not, then why are mexicans jumping the boarder, why not get into a plane, also why do so many people whine about drug and arms runners, when the simple solution is to man the smaller air strips. DOH!

No problem Jake.
that is correct. It is your kind and romantic soul reaching out to try to help this poster.( A little naive too, but nothing wrong with that.) Smile

The plane is very expensive. also very risky. A lot of pay offs involved. Cartels run a lot of this. in addition to the price, you will have to deliver cash or even drugs as part of the deal.

The border jumping is dangerous but less expensive. Many people of substance will not even think about that route.

Any plane from a foreign country when landing is required to do so at a designated POE airport. A flight plan for a VFR flight isn't required but it is recommended. If they flew in and landed at some place other than a designated POE airport then its a safe bet these were drug runners.

Had they been following any rules at all they would have run into trouble landing somewhere else. BF would have been cuffed by customs. Assuming they didn't tells me they flew in low enough to avoid radar detection. No accident.

The BF is involved in it. They don't let excess baggage take up space on those planes. Every pound is accounted for on a small plane. With that, he ain't so innocent.

Vote Republican and this country will still be worth sneaking into.

Them drug lords and dealers always sneak into country by flying private jets. Why did this person not take a regular route and entered the country through inspection?
