I am trying to find the correct answer regarding the "general rule" about an illegal alien w/2 convictions. Her conviction was for child abuse (felony-3rd degree), it was deferred ajudiacation but was revoked because she was then arrested and convicted for theft under $500. Her 1st conviction she was given probation for 6 years(sentenced to 2 years-suspended-after revoking def ajud). The 2nd conviction was given 6 months-suspended- probation for 2yrs. She keeps getting different answers from different lawyers so I would like to just tell her the truth. Please help and thank you ahead of time.

Convictions for child abuse and theft...what a worthless character. In my opinion, she has zero chance...and deserves zero chance...to gain legal status in America.

First of all, I did not excuse anything that she might have done as I do not lead my life in that way nor do I condone it. Second, the reason I called the remarks racist is because while you and the other poster might have your own beliefs regarding illegal aliens every posting that I have read, the poster made derogatory remarks about the entire race or the person(s). To make an assumption about an entire set of people is stupid. Also, to call me stupid for trying to find out the guidelines without really understanding my motive is stupid. Not once did either of you ask if I felt that she should be allowed to stay-you just assumed. I didn't object to your or their stance that she not be allowed to stay in the US, I made objections to the name calling. I posted the question so that I could find out the TRUE facts about her situation. While I understand your anger at finding people here who have committed crimes, I don't understand the need for the words that you choose to use about them. More people might listen to your thoughts and views when you back them up with reasons that do not point to the persons' race. When you attack a question with the words that were used, you lose your audience and you do not get the real facts surrounding the situation.

Nor is it racist to object to people who are admittedly here illegally, and are convicted child abusers and thieves. These are facts that you yourself presented. You are correct except that I was talking about the poster's other postings in which he does attack using race. But once again, no one has actually asked me my views on her situation and never once did I call her "my friend." There are other dynamics to this situation-her US citzen children. Did it ever occur to anyone that I am trying to find out the guidelines for their sake? I reiterate-I do not approve of what she has done! I just need to know the specifics so that I might help her children if needed. Because truth be told THEY are my concern. I wanted to find out guidelines not receive judgements on my character and my thought processes. So, if anyone has anything having to do w/guidelines I'd truly appreciate your help. Please remember, she might not deserve anything from anyone of us but her children are innocent of her crimes and have not committed any of their own or I would not be doing all of this.

None of us are offering legal advice, but child abuse in particular does not bode well for her chances of convincing a court that separation from her U.S.-citizen children would rise to the level of extreme hardship to them. That's what she'd probably have to do to avoid deportation. Child abuse is an extremely strong taboo in this society, and the reason for much of the harsh tone of the responses you've gotten.

Thank you for your comments. I do understand the anger toward someone convicted of child abuse. I see your point in convincing a court of that she is what these children need in their lives. Maybe I should have started out by saying that I am trying to figure out if I will be needed as their guardian if she is sent back to her country of origin. Then maybe other posters would have understood that I really was on the kids' side in all of this.

Do you ever read all responses or do you just attack? If you had bothered to READ you would have seen that I am not a supporter of this woman. I was seeking KNOWLEDGE!!! So I guess that makes you the moron. It makes me so sad to think a person could get so angry over a simple question that they can't even be rational. Well, marrying her would probably get you on another soapbox since I am a female. No, I am not doing this as a courtesy to her. If you had read any of the postings, you would know that by now. So, I don't have an IQ or morality problem. Maybe you should look into filling your life up with more worthwhile things than spewing anger and hate all day long. It seems to me a course in Reading Comprehension would be terrific for you since you have a problem w/only picking out key words that allow you to twist a posting to make it something you are against. Do you like anyone? Because in that last posting how many groups did you slam? Or do they have to think your exact thoughts to be worthwhile?
