i have a green card visa and currently working here in the US. I was married last yr to a husband who works as a nurse outside the US and with pending employer-based immigrant visa(filed 2007 before we got married). My question would he be approve to apply for a tourist visa to visit me here in the US despite the fact that he has a pending employer based immigrant visa?

not likely since no one would believe that he wouldn't try to stay in the US
