My wife a Legal Permanent Residence filed two Alien Relatives Petitions form I-130 in Sept. 2000.
She became a US Citizen in March 2006, upgraded the above I-130's of unmarried sons and daughter over 21 years of age.
Received a letter stating that your Petitions have been upgraded, it took three months to get this letter from the service center.
When I checked on the website of the Texas Service Center they are processing May 2001.
When checked at DOS website it shows Jan.01, 2000.
I understand that DOS control the visa numbers,
if you see June 06 visa processing dates it shows April 22, 01 and how come in July DOS started 01JAN00? see visa bulletin from last Oct.05 to June 06.
If this category is oversubscribed then they should stop taking applications for the Diversity Immigration(DV) Category in which they used 55000, originaly taken out from the worldwide visa numbers.When we already have to many applicants in line then why should we take more and over burden the poor DOHS.
In many cases most of the visa numbers are returned to the DOS each months.
Will appreciate yoursuggestion in this regards.
uscis also asked if we have an Attorney, do I need one to speedup?

Well I am surprise why the uscis had not yet approved the petitions, they wants to hold on to it for what.
They can approved it and let the applicants keep checking at Visa Bulletin and US Embassies, which they used to do it in past, it will make the job more easy for all.
the Visa Section of the Consular Affairs had been out of their minds.
I do aggree that DV should be stoped untill we clear all the pending cases of USC spouse,children, and unmarried children.
If your unmarried son/daughter are in US then you can also file I-539 to change the status to an immigrant or they can file for permanent residence I-485, I am not sure about this can some one correct please.
