Hi all, I filed my I-130 with the service center three weeks ago. I can see my check for fee is cleared but still have not gotten the receipt. Do I have to have the receipt to file I-129F for K-3 Visa? How can I prove that I filed I-130 and is pending?

You should not worry and have patience. You should receive the reciept every day now. Good Luck!

Thanks Ramalotti! I do look like out of patience but my concern is if some reason I did not receive the receipt or got lost in the mail which is very normal that means the wait turns from weeks to months. We can't call before 30 days of filing the case. Thanks again!

give it a couple of more weeks then. on the back of your cancelled check, you will see the receipt number, which is assigned in that I-130 app.

Thanks! I viewed the check on line but does not have any number refrencing LIN??????? on both sides of the check.

I found this thread by google search. I am in the same boat as you are. USCIS TX Service Center received my I-130 application on April 12. They cashed the check on April 25. Check does not have any A number or Case number on the back. It has nothing handwritting. All numbers are stamped ones. So no luck with tring to find the case number and searching for its status online. Today is May 11 and I haven't heard from them yet - no NOA receipt. I am anxiously waiting for the I-130 receipt so that I can file for I-129F and I was wondering if I must wait for the I-130 receipt before filing I-129F. I received the instruction sheet that comes with Form I-129F and it says this on Page 4:

U.S. citizenspetitioning for K-3 visas for their alien spouses must also include evidence that they have filed Form I-130, Petition for Alien Relative, on behalf of the alien spouse listed onthis form.

It does not ask for "receipt" but instead "evidence". I was wondering whether the USPS delivery confirmation and the copy of both sides of the check serve as evidence that I have filed for I-130?

Hi Trent,
This is what I am curious about! Does not seem like there is any alternative unless somebody tells the experience not guess. I won't send I-129F without confirming because it may cause more delays. To me this is a game by the center. Couple weeks ago my cousin applied I-130 for her parents and she got the receipt within two weeks from the same center. I have no clue how they prioritize the processes. I'll sit and wait till get other rsponses or NOA from the center. Thanks and Good Luck!

My understanding was that you could file them together? Sometimes the I-130 is processed faster than the I-129f.

Yes, I have heard and read about people filing both apps together and having no problems with it.

I am not waiting anymore. I am filing my wife's K3 on Monday. Nowhere can I find within the "official" guides on USCIS that K3 requires I-130 NOA. It does require "evidence" that I-130 is filed and I believe evidence to prove that USCIS took the $190 app fee for I-130 and the USPS delivery confirmation are evidence to that fact. I'll include a letter explaining why NOA was not included.

That's very true there are not any guidelines about the proof of filing I-130 or we could have filed together. But there are guidelines that K-3 apps to file with Chicago Center. I filed my I-130 with Lincoln Center. I am little confused with this double standard process.

Which service center did you send your I-130 to?
What date was your I-130 received by USCIS?
What date did USCIS cash your check for I-130?

Was delivered on 4/12
Check was cleared on 5/02

I am planning to file with the print of the check and proof of delivery tomorrow. Good luck!

I finally filed my I-129F for K-3 with proof of delivery by USPS and a print of cleared check. I called the Customer Service Center and asked the status on my I-130. Customer service officer told me they don't know where Lincoln or Vermont ship cases after they receive. Suppose to be California for west coast and Vermont for the east coast. But that is not the case she experienced this morning, one west coast case was sent to Vermont.

My case is sent and received at California Center on 1st of this month and still have not given any file number. Now I have to wait for 2-3 weeks more to get the receipt. Per this officer it is must to file I-129F for K-3 visa with the I-130 receipt which I-129F instructions are not very clear about this requirement. I still wander if our paper work is processed in US not got sourced out like other companies.

If the requirement for I-130 receipt stays valid, anybody knows I'll be getting the letter to submit or they will send my petition back? Thanks!

Hi,

I do not understand why you did not apply to the Pilot program in Dallas, TX. It would have taken you all in total 90 days to have gotten the green card. It is only for those who file !I130 form together with three other forms. It is a very quick proccess and it comes together with the work permit too and you have to pay nothing for the work permit under this program.

This pilot program is available for people who live in El Paso or in Dallas area,TX.

You can always send copy of the receipt once you receive it, with a letter explaining why one was not included.

I was wondering what if the receipt is lost by USPS. Are we supposed to wait forever? It looks like no one at USCIS has any answer for that. So instead of waiting, I'd rather just file I-129F and see what they have to say about it.

If you're referring to the D.O.R.A Pilot Program, it is not for K3 applicants. It is for those who have their spouses already in the US and are adjusting to permanent resident status (I-485).

Trent, so have not filed tha case yet? You acclerated me to file and it is there. This is unbeleivable not having clear instructions. I think they are making sure attorneys are getting paid as well, why provide every information on the forms.
