since 2005 i have a case and it was including a lot of processing and many mistakes from the embassy. anyhow i filed my I 130 (my wife did)
in 2004 but i came now through k3 visa but still i have not received the answer on my i 130

does anyone know what should i do before i start the processing of change of status and stuff

thank you

K3 is good for 2 years.

You have been out of status since 2006?

And now you ask?

If you are out of status, your are in a bind. The 5 and ten year bars affect you and you will need a waiver of the removal charge. Please go into the nearest USCIS office in person to check the status of your I-130.

you guys did not understand what i wrote
i said my case started when i was out of usa but i have just come here like 3 monthes ago
no bars, no waivers
i am asking now about I 130 which should be answered since long long time ago
my k3 visa is brand new, so thanks for the advice

You have to refile to adjust your status in the U.S.

There is a chance the I-130 was already approved back then. You should verify the status of that application first. If it fell into the dead zone you may want to follow the procedures based on the current k-3 instead.

Tara, the I-130 is a form to establish a relationship between a USC/LPR and an alien relative. Once done a visa is the next step.
