my friend worked this company couple of month w/o her EAD.and the company issued her w-2 form.
(she has valid SSN)now she's worried because is this show up at her AOS interview.FYI,she worked this company over 4yrs ago and didn't file w-2 at IRS.and there is no criminal conviction.thanks,

Your friend.. aos based on marriage or employment? If marriage, all illegal work is forgiven.

Also currently, IRS does not share information with Immigration. this w-2 is more than 3 yrs old and that tax return is considered "dead" return. Suggest if this is employment based interview, that she file that tax return if requirements were applicable to her filing.

yes,her AOS is based on married w/USC. btw,what is "dead"return?that means this w-2 is not exsisted no more? does she still have to file this yr2000 w-2 form if IRS aske her to do so?

If she met income criteria that did not require her to file, then she doesnt have to. She can file regardless, but if she was to receive an income for tax year 2000, she forfeited it to the government. thats what I meant by dead return. No refund will be paid to her.

Best advice, is just to file it so that it is not an issue at some later date. Smile
