Does anyone know if it is possible to get an H1b visa while waiting for an I140 (nurses) to be processed through consular processing, as long as the h1b is with a different employer?

Since your H1B is not approved at the Consulate yes, so you can not change employer. The other employer can institute new proceedings for your H1B. If you were in the United States on H1B then it was possible to change/substitute an employer.

It might be possible, but the problem is that the underlying intent of an H-1B petition (nonimmigrant) conflicts with the underlying intent of the I-140 (immigrant).

So, if you file for an H-1B, just be aware that you stand a chance of being denied due to dual intent.
