Seren, RobinH... etc. Accept my sympathy for all your difficulties. I have been going through the same mess since April of this year. I can relate to your difficulties. Here are a few piece of advise for you. (1) Do not take the bull by the horn. Tackle your problems one step at a time lest, you may loose your sanity and thats what the fraudster wants. (2). Walk the walk and talk the talk. Do not rely solely on your attorney to give you victory against your spouse. There's is power in being a Pro Se candidate in court. No one knows your situation better than you, you, yourself. Therefore, believe in yourselt. (3) This forum is full of HONORABLE and knowlegeable members. Utilize their expertise whenever necessary. Without these members, I would not have attained the point I have reached in my own case. (4) See your battle as a puzzle to be solved. Look at your battles as challenges in life that you must overcome. (5) Appeal every unfavorably court rulings. Sure, waht else do you have to loose. Learn to do your own pleadings. (6) Write the appropriate USCIS offices concerning your case ie MARRIAGE FRAUD.
Those are a few of the advise I have to give. My case is not completely over but I have the upper hand over my fraudster. I have succeded in withdrawing her petitions, I have also succeded in annuling the marriage thought by default. I am going for the next move against her which I will not disclose here because she and her attorney uses this forum. Nothing, Nothing can be sweeter than JUSTICE so seek it until you find it.

I Personaly Have Friends From many Of The Cultures Mentioned Here! They Too Agree That Those Of Deciet and Ways Of Moral Turpitude Need To Be addressed!!!!  . Affects All in The Long run!!!!!

As Kmail said, don't give up. To be defeated by a fraudster of any type will never give you peace. No matter how much you want to 'move on'. You will lose a portion of your dignity and self respect if you don't defend yourself. Keep fighting and adopt tenacious as your first, middle, and last names. Time is on your side. And to emphasis the point with lawyers. They will represent you. But you must tell them what to represent. Leave no stone unturned. Even the slightest seemingly inconsequencial detail can make a case. You must become your own best attorney. Sooner or later the scammer will give you the evidence to hang them from the yardarm. Just make sure your standing there with the noose.

When you sponsor a person for residency, YOU are the one telling society (the "government") that the person is okay and that you are backing up that sponsorship with your reputation and financial commitment. The government ("society") only checks to see if the person is not inadmissible according to the immigration laws (e.g., not a terrorist, no criminal record) and that the two of you are not scamming in a money-for-status scheme. All of us who have been divorced understand a marriage getting sunk, and the reasons for divorce are infinite. However, in the end, the parties-to-contract, and not society (the "government") are the ones who said "I do" and any fight, legal or otherwise, is between them alone.

One of the biggest problems!! Some of these immigrants are trained for years to deceive Americans, and the System of USA. Their ability to ACT and fit the desired picture of the USC is Extreme!!! Those that are Doubtful of This obviously have never personally come in contact with this fraud within their own lives. looking from the outside is Different than seeing from the inside!

In my case the inlaws came for a 6 month visit. The trouble started right after I sent for them. They took control of our home, making demands that were out right illegal. I told them I was not abandoning my daughters from a previous marriage. I would not give them my tax payments. I would not give them the money that I was using to build my business. I did give them money, but they wanted more. That was 7 years ago. Their visa's have long since expired. DHS has refused to send them home, and gave me many excuses. The inlaws finally got tired of fighting about the money I was making, and ordered their daughter to divorce me. In this way the court would make me pay them child support.

And that my friend is a common mistake. Learn to use the latitude of the law. It is flexible. And you don't have to cooperate fully with the enemy.

What is it y'all want? Sympathy? Pity? Just in case it ain't clear enough, life's not fair, not a nice ride with rainbows and puppies, it's about loss and pain and suffering. So don't come here to cry and whine and think people will be sorry for you. You don't like it, that's too darn bad.

Houston, No one is crying and whinnig here. Americans and decent immigrants are crying for their beloved country (USA). They are crying because the system that is suppossed to protects its citizens has turned its back on them. The system has empowered criminals and fraudsters to perpetrate evil against its citizens. Americans are asking their government to give them fair and at least equal hearing to present their cases before the immigration judges against their respective spouses. How would you feel after you have wasted your resources to bring a poor fraudster to the land of opportuinity and in the end, the fraudster alleged domestic violence against you as a means of securing GC faster? Our government is the problem not really the people. Our government is not responsible to its citizens period. The system has empowered illegal aliens over citizens. The probabily of any marriage victim to be a victim a second time is very low, so how do we warn others of this danger? Awareness is the key and I belief that is one of the goals of suing the responsible branch of the government. I support all efforts to raise global awareness on this issue. The problem is even worse in Canada. For those in similar situation, Davdah has summarized it thus "You must become your own best attorney". In other words, you have to be the driver of that vehicle and not the passanger ok. Peace.

We have come here to organize and seek justice. "Those who are well have no need of physician except those that are sick". I came to this site because I have problem and if I can help others to at least warn them of the danger of marrying an alien I will be very pleased. I used to hear the stories that it happened in other cities and states. I least expected that it will happen to someone I know talkless of myself. Here I am, experience is the best teacher. Such problem has opened a whole new meaning of the world to me.

First of all, immigration court is not a court-of-equity, nor is it a family court, nor is it a criminal court. Before complaining about immigration judges, it would be good to know the limit of the authority an immigration judge has. If the USC spouse believes sometime after having sworn up-and-down regarding the bona fides of the marriage to the federal government that the marriage is not "real," has not tried (and succeeded) to get the marriage annulled due to fraud in the onset, has not exercised any civil suit for slander or libel regarding a false VAWA charge, or has not filed a criminal complaint against the foreign spouse for fraud, then what do you expect "the government" to do? There are many avenues for relief to the USC spouse, but they all require effort. Unless these avenues are attempted, and there is some EVIDENCE that there was fraud sufficient for ICE to initiate immigration court proceedings, ICE does not have a case to present before an immigration judge. It all goes back to not doing "due diligence" in fiancee investigation prior to getting into a marriage contract. "The government" cannot prevent people from getting married when they want to in spite of common sense.

These are the Loopholes! The Laws and Procedures in America Concerning these Issues are Flawed! This is why Immigration Laws and Procedures need to change! those from afar have already studied these procedures and Loopholes. family and friends relay the information over time with their own success stories and methods! Now it needs to change so those with bad intentions have to start all over again with 20 years of proven method on their side, that will no longer be valuable to them With the new Laws and procedures!
