The good news: My I 130 was submitted June 30 approved August 18th. One problem, they think my husband is in the USA, on the profile and the I 130 I had his European address. On question 22, I assumed that the 129F would be approved first so he would file change of status in USA. NOT. The I 130 was approved first. Now I had to submit an I 824 and it takes ten months to process and send his file to NVC.

It looks hopeless. So close. Ten months. Any ideas....If he comes under Visa Waiver I am afraid that he may face problems in the final paperwork by violating the change of status rules. UGH...does anyone have any ideas. I think I overthought question 22, I still have nightmares.

Where did you get the information that it will take 10 months to process?

The NoLo book mentions this briefly, it said that it is not the worst thing that could happen and that assuming the K3 is still being forwarded to the consulate, the consulate can help him. (Not sure what they meant exactly, they could have been more specific...) The initial approval of the I-130 doesnt stop processing of the K3, does it? Cant he still come sooner than the 10 months with the K3?

If you get any more info, please post it.
