i called o friend of mine,,and hes brother knows n attorney in san diago,,so he gived him my number and he called me and explained my setuation to him in details,,and he told that yes i can file,,but he said he will gt back to me tom,,so he called me again this morning and he said he contacted the immigration just to double check,and i was suprised when he said they the immigration said i can file and he even said once and twice not even once,,and he said ther were a changing in the law's and ther is no time limit for me to re-file the 751,,he said this is for sure wont be an issue about the time,,and 100%,the only thing is to get all the evidence from my ex and no worry for the time for sure.and i dont understand about more than 1( 751),,but this is what e said,,he told me a story abot some colombian woman got her 751 waiver after 2 years of her final divorce,,,so i think i have better obtion now my friend,,and i will get all the documents together and then i will file,,,so i think this is a good news,,and he promissed about the time,,he said dont worry about the late filing,he just dont understand why all the other lawyers went thru the i-130

Well Im glad you believe me now. but still send that letter, trust me on this. just short and simple about how bad lawyer advice did not have you send in 751 waiver.
Remember, that lawyer is talking to customer service, and most of them dont work for uscis and are outside contractors. and they dont know things, or just make up answers most of the time.

And I havent seen any new memo or update on there is no time limit on filing 751 waiver.. there has not been any changing the rules per say.

ooh no,,i didnt say that i dont believe u,i owe u for this bcoz ur the 1 who supported me and give me this idea,,its just happen bcoz i was telling my friend about it and he's the 1 who hi involved,,but actualy he got me confused about this 2 or more 751 ,,how?but anyway,,oh yes,i will make that letter,,he didnt say i dont have to at all,,he said the same thing,,i will put the blaim on thoes a s s h o l e s lawyers who charge me $12.000 dollard for i-130,,he said its a good idea to blaim them to make me look better,,but he said they wont just denied it,,he said omething about i can file it twice and as many times as i want,,i dint c how,,but i dont care ,,all i care about 1 ,,if this gets inside then i will get my status back,,or at least i will enter,,and hopfully thoes idiots at the boarder wont denied my entery like the first time,,,and he said he have never seen an i-130 gets denied in hes 25 years career,,even ppl with previous deportation gets ther i-130 approved and then the embassy will denied the visa,he said its strange to denied it if ther not accuseing me of a fraud marriage,,,bcoz he said they cann't just be thiking its fraud,,or the first 1 was,,they have to mention it on the letter,,they cann't just denied it bcoz they think so,,so thats strange,,

keep your letter short and precise. just point out short details like my post earlier in the week pointed out.


I think the i130 package got denied bc the removal proceedings was checked off, there was not any evidence of living together after marriage date, and the mexico information would not have allowed you to attend the interview. it was such a nightmare that they just denied it.

I think he is confused about the over and over filing of the 751/ if you are denied. you will get a chance to explain your case in removal proceedings in front of the IJ who will approve you or accept uscis decision. This is why it is important to make sure everything is in place when you file this application now. You can not bring in any new evidence after the denial. only the evidence that was presented will be considered. dont forget anything.

i dont kmow,,,but it's still strange,,even if it was marked on the removal proceeding ,,but i wasn't deported,,but who care now,,this is not the case anymore,,but this is the question again,,how iam going to c the judge if iam here,,can someone do this for me...like an attorney or my current wife or something?bcoz i dont think they will let me cross if i have a court,,and thats what i dont get,,how removal proceeding if iam not even there,,

Remember i explained that if 751 got denied, and it doesnt look good., then you will file a i130 again and wait for it to be approved and try to adjust on the current marriage.

but dont file i130 yet now. 2 different cases. its just that you have options at this point

Stop jumping ahead of things. concentrate on 751 and letter and get this to your wife by dhl or ups so that she can make a fed x to send for you from her address and state

i read someething and iam concern about it alot,,what does that mean?(if the waiver the I-751 form) is file late or denied, a VAWA self-petition may still apply.so now what is the VAWA? thats number 1 ,,question number two,,on the 751 waiver,,if i check the box were it says extreem hardship,,can i use my current wife as the extreem hardship????????

the only box you will be checking is good faith marriage

forget about vawa it doesnt apply to you and forget about extreme hardship. this not applicable to your 751 waiver.

yes i did but iam so mad,,,very mad,,,iam done with it and the letter and half of the evidence,,but i called the stupid donkey lawyer and he told me that he have lost my (FOIA) file ,, ,,and to give him 2 weeks to find it,,iam just going crazy,,i wish if i was there,i would go to hes office and kick hes ***
