this is new application. if it comes up, then it will be addressed. it was never necessary to disclose that, and that was a reason you got denied because you were not able to be physical present for interview on the i130.
this is a new application and we not going to worry about that i130 becoz its going to be withdrawn anyway. and you just had bad bad advice surrounding that whole thing. the letters asking for you to let in when you were out of status. etc. just wasnt going to happen. couldnt happen.
only way to get temporary status back right now is filing this waiver.
also. you have to stop thinking like this !! you do not live in mexico. you dont. you are stuck there since you went on vacation there . you were out of status when you crossed into mexico.. no if and or buts... doesnt matter what your paperwork/passport was stamped or said. you cannot get a reentry pass based on the fact that you were not in status when you crossed into mexico... you just thought you were in status.
so this is it. make everything good and not questioned. and hope to get new 797.

yes i think you have chance because the 751 joint was filed and not withdrawn by your 1st wife.
the problem is, getting the service to accept the late filing. once they accept it, then just a matter of adjudication. even if uscis denies the waiver, you will have a chance in front of the IJ for adjudication. and even if that fails, you can file a new case based on current marriage. so there are options. but you must get back to the usa, and this is the only way right now. i130 will not let you come across that border.

no. what i meant is she didnt withdraw it citing fraud or something like that. even if she did do that... you still could file the waiver becuase of the divorce. it has no bearing. the waiver is allowed because of the divorce.
once you get the extension, you will be able to come back across the border. so pray pray. they accept the late filing.
get everything ready for file for the 751. then we tackle the letter for the late filing. I will be busy this week but late nite i will be around.

didnt even know it was possible to file until recently and now you have gotten good advice and are now filing the waiver 751 based on good faith marriage. You even Had a problem getting copy of divorce decree which further delayed filing 751waiver. also requesting evidence in file from the joint petition be considered with the enlclosed evidences for the 751 waiver you are filing. After the extended time, it is hard to gather evidence from that far ago.

sorry... dont count on that. it may be an issue. they dont have to accept. I dont think it will be an issue, that is where the letter comes in to make sure it is not an issue. the instructions say it will be accepted with extinuating circumstances. Every one in the past I know of that has been accepted is based on extenuating circumstances as to while it was not filed timely.
do the letter, stop listening to lawyers that do not know what they are talking about just to make more problems for you.

if it is denied. You will receive letter telling your status is terminated. and you will have opportunity to have your case reviewed in removal proceedings..before the IJ.
of course you can hire a lawyer who will ask for a continuance in from of IJ with a good reason of course.. which will be a filing of the i-130 based on the new marriage as last resort. but make sure at some point you will have to appear. but thats another story and im not going to deal with "what ifs" at this point, as it is an energy drainer. and your concetration should be on making sure everything is in order for this pettition to not be returned for missing docs etc.
cross that bridge when it comes to it. it will depend on reason given for denial or not accepting late filing to worry about strategy at that time.
