Ok still you didnt answer my question if wife filed I-864 with your aos package? yes or no


Im asking this because Im trying to determine reason for i130 denial for you to appeal so that it can be withdrawn by you.

Now it is up to you.. but you would be foolish to not file the 751 waiver and have 10yrs card.
You have very good reason incompetent attorney and bad advice from attorney as to how you should have proceeded in case. It has only been ah 15 months yes or no?

this is good.. tell your first wife to start gathering all the evidences you submitted and to write a letter on your behalf that the marriage was genuine , but she found another booyfriend becuase you worked too much. etc.

What court papers.. with what charge????
and which one of those did you take. I know you keep saying you didnt do voluntary departure. so what are those papers

no that paper i recieved before i saw the immigration judge,u know when they tell u that u have a court hearing and u will be elligeble for this and that ,,when i was in custody,,,it says that at this time and day i have a court and i will have thoes options,,,but when i saw the judge he didnt cre about all that,,he was just talking about the i-751 and how to get it back ,,,which was better for me,,,ok regard ur question about the i-864,,no we didnt ,,bcoz i think this will come next,,when the i-130 gets approved and they send it to the nvs then we will file thi no?but now iam going crazy about the i-751 ,,u screwed up my head,,but in a good way i mean,yes i been in mexico 1 year and 3 weeks now,,so is it for sure that i can still file again?if yes then its better than waiting for the stupid i-130 and start all over again

will look,,,that idiot lawyer when i went to mexico ,he told my wife that he will file the i-130 ,,so we called bac in october 2006 and he said he did and he recieved the first noa,,so later in jan we find out that he never did ,,,so my wife got in a fight with him and she filed the i-130 and the i-129f together,,they process the i-130 and we got to this point but the i-129f is still stuck ,,no respond since jan2007

After reading through this a couple things jumped out. When you were in custody the 751 you had in place was still valid and was denied the next day while still in custody. Immigrations assumption was it would be a deportation hearing. Judge tossed the whole thing but the 751 was not reversed to prior status. That seems to be where the problem is. The people who reviewed your paperwork assumed since it got canceled that it was a deportation when in fact it was not. An attorney can probably get this corrected but you will need to get a court date in front of a judge to undo that fiasco. I don't think your first marriage is in question since you already had a GC.


You voted democrat. This country is not worth sneaking into any more.

751 could not be reversed. alien was divorced already. lawyer should have filed a 751 waiver based on bonafide marriage. but was incompetent and didnt

ur both right,,thats what i thought too,,i think bcoz they saw the question on the i-130 if i have ever been in removal proceeding and i said yes on the i-130 ,,so thats why they maybe thought i was deported,,but the truth that i wasn't,,,well,,,how is this appeal proceeding thing work?is thw attorney have to go to court with my wife or it will be dont by mail and letters and forms or what exactly?thnx god i still have a copy of the paper that the judge gived me,,,and it says he was allowed to withraw hes application for admition and waived by both.

True, the baboon lawyer should have gotten the waiver in before this even happened. Still, it may be something easily fixable if he can get an appearance. The evidence he submitted was more than adequate for a bona fide marriage. I think its the 'almost' deportation hearing that is hosing this up. More than likely your wife with the attorney will have to make an appearance.

thats true,i crossed on september 10-2006,,and the 751 was valid until april-17-2007,,but that stupid a s s lawyer didnt even know what the 751 was,,bcoz i remember my wife faxed it to him and he said,,oh this is not good anymore,hopfully everything will be ok,,but i still dont know how long this will take for the i-130 appeal,,i cann't find anything about it online

Mike, let me ask you, how are you doing in Mexico being a Jordanian citizen?
Did they give you a visa to stay, do you work, how do you support yourself over there for more than a year now?
Just curious.

no,,actually i dont have any legal status or anything,,no job,,no visa,no nothing,,and no income,,we been barrowing from friends and family members,,its really ****s over here,,even that my wife was born in mexico but i still cann't get a visa,,i went one time and they want to c a green card in order to give me a status,,so i dont know what to do with this too,,lawyers are cheaters in here,,they asked me for$7000 to get me a 3 months visa and it coast $25 at the boarder,,but oh will,,what can i do,,i guess iam ganna have to digg on the humanetarian visa or something

just got back in..

i see you are getting off track already.

your wife will not maake an appearance in front of ij she does not have anything to do with this situation,.

i130 issue is dead. a 10 year bar will come with it as you have been out of status for more than 1` year now. you are illegal status and if you enter the country now you will be considered a undocumented illegal and wont be able to adjust status on us soil based on current marriage.

dont give those mexican lawyers any money.. no way no how.

heh

it was your choice to leave the country. you left usa to go into mexico. you got jacked at the border b/c you didnt have 797 current to prove your expired green card had been extended. The border guards did not accept your 551 stamp in your passport. being cautious they lied and called ice who took you into detention until they could figure out waht was going on.

when they did find you had a 751 pending, and now knowing you were divorced, they ruled on the 751 as denied because it was no longer eligible for adjudication under joint provisions.

Now... helping you out of the false us citizen claim, they told you to withdraw the application of admission to usa from mexico. they had to take you back to mexico as though this never happened. they expected you to get the 751 waiver filed to get new 797 to allow you to cross the border legally. it didnt happen. Judge would have adjudicated 751 for you, but lawyer didnt prepare it. all these things never happend.

and now you are still there and still have not filed your 751 waiver..????/ what are you waiting for. You could not have stayed in usa becuase you were arrested for false claim of citizenship, which could have barred you for life from usa. this was a good solution on their part and a favor. you dropped the ball. Frown

These are the rules. when a person as accrued more than 180 days of illegal time bar is 3 years.. more than 1 year is 10 years bar.

it is because you are not supposed to be in the country still as visa or papers have expired. it is the punishment.


Now do you understand the importance of what i proposed you should do? it is only way around the illegal time accrued.
