whatever sonofmichael,,,thnx alot proudusc,,the only question that i have and i cann't find it anywere,,the i292 appeal letter,,i cannt find the process for that form,,on the link u give me it's showing the process for all forms exept that one,,some of them showing current and some other 20 months and so,,but i cann't find the process forthe i-292 anywere

it says to either file the appeal to the same local office whitin 15 days,,or to the BOA whithin 18 days?but how long the process takes,,its not showing what form on the web?

whats your plan of action now. Now You need to file 751 waiver for bonafide marriage. Cant believe that idiot lawyer didnt tell you this in the first place. still in contact with first wife.. if so see if she kept copies of what was sent for joint petition. if not, FOIA filing should be able to get what was sent . copy of divorce decree must also be sent along with the filing fee pictures, proofs that the marriage was ongoing for the 2years after the conditional gc.

Maybe just as well petion on 130 denied. cant have 2 petitons ongoing at same time. if this waiver gets denied, you can always file again under this marriage.

you need good excuse for the late filing.. its not too late, but need experienced attorney in this matter. you should then receive new 1797 extending your card while it is being adjudicated and you will be able to cross border to come home and await decision.

keep your chin up it will all work out. inshallah

hi 4now,,thnx alot for ur support and yes ,i will ignore that idiot,,but u know something ,,i dont think this will work,,,bcoz my previous i-751 was granted bcoz of my previous marriage,,and soon as u get divorce,then u lose it,,,i understand about that stupid lawyer should have filed an i-751 waiver,,but back then,,and the fact we didnt whithin 90 days ,,so i dont think i can refile again now,,specially that i left the country ,,and i got re-married again,,so now i have to start the process all over again,based on the new marriage,,but the problim that they denied the new i-130 ,,i was looking at the link that proudusc gived me to c what form that i can use to appeal ,,and i cannot see it anywere,,if its current then no problim,,but if its months then i guess iam ganna have to apply for humanetarian parole,,thats what i need to know now,,which form we have to file to appeal the i-130 denial?the link she gived me is very good,,showing the process for all the appeal processing,,but the problim i dont know which 1?and hopfullyyyyyyyyyyyyy its the i-600 bcoz the process are curent ,,but i dont know,,,iam ganna be digging now on the humanetarian parole in case if they denied me again,,but based on what the lawyer said,,he said they made a mistake,,but the bad news is we have to appeal it bcoz they wont addmit it

You see mike.. this is what i am talking about
lack of knowlege in matters. does not matter that you are married again. besides, you will have to prove the first marriage was not a fraud anyway before they will approve adjustment on the current marriage. what better way to prove it than having an approved 751 waiver on the first marriage.

I already told you not to worry about the 90 day thing. this happens more than you know. you can prepare the 751 waiver yourself or your wife thats not the prob. You need an experienced lawyer that has filed late 751 before... thats all.

humanatarian parole is way off base and not related to your issues. YOu are in another country becuase you do not posess proper documentation to leave to come to usa . file your waiver and get 797 extending you until you are adjudicated.. either approved or denied.either way the 797 will give you status to come home

You can appeal the i130 and will have to withdraw the package for adjustment if you file 751. stop wasting time on bs like things that dont really pertain to you. start doing research with shusterman or metha.com lawyers for questions. no time to deal with amateurs and do gooders advice right now. this is advanced immigration stuffs.

then again... if there is something u not telling us about 1st marriage situation...if probablilty of fraud being indicted. talk man

one more thing... did your wife file affidavit of support with the adjustment package for you with the i129? if not, then that was one of the reason for denials


Also.. be aware that you will need a new sponser for the new 751 waiver.. as your other case is closed (the joint petition)

Keep in mind that new aos will not get you home.. i797 extending you for 1 year will let you cross the border

thnx alot,,no ,,it wasn't fraud,,infact i have new letters and emails fom my ex wife saying that how much sorry she is about the divorce,,and how sorry she is bcoz she didnt treat me right,,but offcourse its over bcoz iam married now,,so that should answer ur question about my previous marriage,,and second of all ,,,can i really file for waiver for my previous i-751? i wish,,i will work on this,,but i remember i called 4 lawyers and 2 of them are really good lawyers and very famous ,,and they said the same thing,,they said i aggreed to leave the u.s when the judge allowed me to withdraw my application for admition,,and thats why i cannot re-open,,but i will take this serious bcoz if i can then its better for me,,and the second thing that iam in mexico now,,,and iam jordanian citizen,,i dont know if this have anything to do with the case..and if i can file new i-751 then i will forget about the i-130 ,,one of thoes lawyers i remember he said,,the same thing that i lost it bcoz i left the country,,but he said if we can get the i-130 approved then he may be able to get the i-751 back,,maybe....thats what he said,,he said bcoz an approval i-130 will open alot of doors ,,,,but i will take this serious and thnx alot

ok listen,,i entered the u.s in 2002 as an immigrant,,in 2006 wh3n i was divorced i went to mexico with my new fiance to c her family,,when we come back from mexico to re-enter the u.s again the immigration officers at the boarder denied my entery but they didnt let me go,,they detain me,,so at the final court thats when the immigration judge while i was in ice custody he dismissed all the charges and it was waived by both the judge and the immigration and i was allowed to withraw my application for admition,but he said he wants to help me out,,,and in order to do so i will have to return to mexico like nothing happen,,so that way i wont be deported or removal or even valunteery ,,he said we will release u and we will dropp u off at the mexican boarder and u enter mexico like u never been in the u.s and ur current wife will file the i-130 and she will bring u back like nothing happen,,like u never been at the boarder and never been in custody or in this court,,so thats what happen,,and i went back to mexico and iam still there,,and the immigration have told the congress office few months back that i wasn't deported or anything an they dont have any grounds againts me,,,thats all

that was the deal,,he said they tried to charge u with a false claim to be a u.s citizen,,and he said the goverment and i belive u didnt say it,,so we want to help u out so u want be charged with that,,so in order to do so,,u will go back to mexico like u never come to the boarder and talked to the immigration officers,,so that way u want be charged with anything

no no ,,when i was in custody ,,the judge asked about the staus of my i-751 so i told him it was still pending and valid also for 8 more months at the day i was in custody,,so he said ,,will why did they put u in here then..so he said ok we will c next court ,,so the immigration like they knew how to **** me up,,they denied the i-751 the nexy day i was in custody,,ok,,,so the attorney file a motion to re-open and it got denied bcoz they said i was in custody ,,,so that was it,,,but then the judge want it to help me ,,so he told my attorney,,there is a different between the motion to re-open the one he filed and got denied and to file a brand new one with a waiver,,ther 2 different things,,and he said if u do then i dont mind to approve it here,,so the attorney didnt file and he never showed up to court,,so i got stuck and didnt know what to do,,so i went to the second court and the judge said where is ur attorney and i said i dont know ,i been calling him all day and he didnt answer my calls,,so the judge extended the court for 1 more week,,the 3rd court i had the same problim,,he didnt show up,,so the judge said we will allowed u to withraw ur application for admition (mean when i asked the ppl at the boarder to let me in the country)not the i-751,,,so i didnt file new i-751 ,,thats what he allowed me to withdraw,like i never asked them to let me in

ok first.. you said you were in detention for 43 days. ice in states or what..



Do you realize what the ij was going to do for you ?? he was going to adjudicate your 751 right there as a favor for your situation. all that had to be filed was the 751 waiver because you were divorced at the time.

did you have a written petition for admission to USA? if so and that is truly what you did withdraw, then you still had in your possesion the i797 extension and greencard that would have let you cross the border. thats what that was about. but you stayed and did not attempt to cross again Confused

Frown,,now i know and its killing me ,,oh my goddddddd,,i wish that attorney will lose hes license ,,i just dont know what to say,,fffffffff,,i guess i lost everything ,,even the goverment agreed that day about all this ,,they were ganna put me back at the other side and let me inn again,,bcoz iswear i remember my wife started crying at the court and she told the judge why mexico?and looked at her and he smiled and said,,dont worry hes coming back ,,and she said when,,and he said if not tomorrow ,,then few days,,its up to ur husband,,ooh my godddddd,,,and that a s s h o l e lawyer said later i locate him lkike 3 weeks after i was in mexico and he said ,,well,,i was in the hospital and this and that,,and then he said,,no no,,we lost the case,,u have to wait until th new i-130 gets approved,,he ****ed me over,,so i guess in this setuation i cannot get it back ha?i just dont know

lets see if i got the whole picture now. correct me where i am not understanding.


Your idiot lawyer filed to reoopen a joint 751 which had been denied becuase of the final divorce. IJ tried to make idiot understand to file a 751 waiver so that he could adjudicate it right there and you would have 10yrs card. Instead he never showed up again even when judge continued case 2 more times.

to cut you a break, IJ and ICE said. withdraw your request to come across border to usa and the false citizenship thing wont be an issue. they took you back across the border like it never happened.

If you still possesed the docs gc and 797 current, then this was your cue to try again.
but you didnt.


Where is the part about you getting married to current wife in detention center? did new lawyer tell you this or the same idiot lawyer that didnt seem to know what a 751 waiver was

answer this and we will proceed

even the court papers i recieved when i was in custody says that i was allowed for 3 things.1-cancelation of removal.2-valunteery departure.3-adjustment of status
