Your case is very complicated, mike_2007. Have you contacted an attorney? If you were traveling with a valid passport (right - good through April, 2007), I don't understand why you were denied entry in September, 2006. Did someone falsely accuse you of saying you were a U.S. citizen? And if so, were you given a chance to explain yourself before a judge? You need a very good attorney - the sooner the better since you only have 3 weeks to appeal your case. Best of luck to you!

First of all... about your false citizenship claim, it was probably dropped not because of liars and evil people, but most likely because the claim must be made with intent to secure something, and if you're entitled to that "something", the accusation simply falls. There's a lot to be said about intent, knowledge and other subjective issues, but we're not going to discuss that.

Now, regarding your current problem. If you're already a conditional resident, why do you need another I-130? It could be something as simple as a failure to demonstrate a bona-fide intent on your previous marriage (removal of conditions).

i never got termination notice for the i-751 ,,and that 1 thing the judge mention,,he asked them how would he know ?he didnt recieved anything,,and no,,my i-751 was denied when i was in custody only,,they denied it the second day i was in custody,,it was still pending ,,yes i did have my green card and my jordanian passport with the valid i-751 when i crossed the boarder,i didnt filed i-751 when i was deteined,,i filed it long time ago when i was still living with my ex wife,,yea it was a real marriage ,,we were togeter for a long time before i entered the u.s the first time,,she was living with me in jordan long time ago,,but anyway,,yes my current wife is a u.s citizen,and believe me i didnt ignore the laws,,infact i called a lawyer 2 or 4 days before i went to mexico and he said i can re-enter on the 751,,but what can i say,,never ever deals with the yellow pages attorneys.but even that 4now,,i wasn't in removal procedding,,i was denied entery and thats was they detain me,,not bcoz i was illegal or in deportation proceeding,,

also there is a very good possibility that you have not been called to Immigration court.

if you have your a# call this number and find out if your case was called.
800-898-7180 follow instructions and get results

if a# not found then case has not been called and you did not miss Immi court

keep fingers crossed

i dont really know,,the attorney said thatonce i left the u.s they will give me 2 or 3 months to reopen the i-751,,butfter 3 months if i dont ,,then my status will be cancled completely,i will check that number right now

And LPR is not seeking admission at the POE. There's a case dealing with the distinction and that's a very complicated issue to explain here but the CIS messed up because they charged an LPR with inadmissibility at a POE but the alien was not seeking admission, even when in theory he shouldn't be an LPR to begin with..... Yeah, immigration law speeds up the aging process...

It doesn't make sense that an LPR, or even a conditional LPR is going to be denied admission at a port of entry when there is no removal proceedings instituted against the alien and the alien has not been convicted of any criminal offense meriting such proceedings.. It's strange.... that's all.

Your attorney did not give you accurate information. You need a good attorney who has handled late filing 751 waivers. and your troubles could be over provided you did not get called before an IJ and didnt show up.

i just checked that nimber,,i was never called for immigration court?never,,and my wife just got off the phone with some lawyer and he said what the hell are we talking bout ?he said they missed up and they should have not denied it,,and he said even the codes and the form is mistakes?what the hell is goinn on now?iam just going crazy..and regard what u said huston,,ur exactly right..iswear this is what the immigration judge sia dat the court ?he said what is he doing over here?hes a legal pr?and then they come up with that **** u.s citizen,,and he said nop,,i donr believe it,,he have gren card and valid 751 why would he say u.s citizen?but anyway,,now iam just finding out,,i was never sent letter to appear in any court,,i was legal,,and now ther telling me thi9s letter is a mistake but they wont change it?what the hell is this ?why not if its a mistake?i just dont know

thats good news

no immigtration court date missed

So you are saying when you came back from mexico you showed current green card and or 797 showing good extension date. they detained you on bogus charge. when you went before judge you still had current dates to cross border .. corect or not? then you said in second day of detainment uscis gave denial on 751 based on fact that you were divorced. Uscis was correct in denying your joint 751 b/c you divorced. if lawyer telling you otherwise, lose that lawyer immediately and find a competent one.

answer those questions first please



ps if you did have documentation, why didnt you try another day to cross with differnet guards?

There is no way he was never questioned about the first marriage. They do not simply "forget" the first marriage. The presumption they make is that it was a fraud unless he proves otherwise. Unless he defeeated this presumption, he has a permanent bar against receiving a new green card based on marriage. This is what is happenning. I doubt very much that this was not made clear to him.

yes i did have my green card and my valid i-751 on me when i crossed the boarder,and i didnt try to cross another boarder bcoz iam sure u understand the fact that i never been in jail or prison in my whole life,,not even in a police station,,so when i was kept ina small cell for 43 days ,,it screwed my mind alot,,and i was afraid to try it again.even if iam legal,,bcoz i was at the first time and they detain me..and yes they denied it whe i was in the detention only,,it was pending up to the date i was detained,,,i understand that point,,but the stupid attorney i had back then should have filed for a new i-751 based on the new marriage or a waiver for the old one after te divorced and iam sure the judge would have granted me that in the court bcoz he was on my side all the time,,and he said to the DA that i wasn't supposed to be in here and he even agreed with him,,but my lawyer never helped me at the court bcoz he never showed up,,but this is what my wife just told me,,she talked to someone and he said it's an error,,u the problim is that they dont care and they won't addmit it..and hopfully i answered ur questions,,

the only thing they made clear to me that the immigration judge looked at my wife at the final court and he said,,dont worry,,hes not ganna be deported or removal or anything,,nothing againts him will be on hes record,,and he is coming back,,dont worry,,,we will put him back in there like he never in this court or the detention,,thats what was cleared,,believe it ot not,,and when the judge asked the DA what does the goverment thinks?he said i aggreed with u 100% ur honor,,thats was itttt

i agree with u iperson,,i love that country and i still do,,but the immigration system is a big joke,,ther giving unlimited power for ppl to decide how ppl lifes will look like and no one can do anything about it,and believe it or not,,iswear i was told at the boarder that ppl from there are not welcome in the u.s and whe i said why,,iam legal?he told me to shut up and locked me up in a cell in the boarder for 16 hours before sending me to the detention,,and when i saaid i have 4 ppl in the car with me will whitness that i never said i was a citizen,,he smiled and he said screw u and ur 4 ppl,,iswear this is what happen,,and its up to u to believe it or not,,and i told the judge this and he was mad,,and he said,,well ur records are blank pages,,and dont worry about them,,thats all

whatever sonofmichael,,ur the brick of wall bcoz u dont understand that i wasn't deported,,and what is ur lazy a s s do for this country but giving bad idea ,,i was there for 4 years and i was a business owner who never got in trouble with the law and i paid more than $30.000 in taxes for the country for my business,,and i bet most of the citizens dont do that,,so dont make comments if u dont know me
