i guess everybody know's about my case,,i was detained ,i got married while i was detained,,the charges were dropped and i was allowed to withraw my application for addmition,,my wife filed the i-130 for me,,3 months ago we sent all the missing documents,,,45 days ago my case was sent to the local office for standard interview,,we sent them all the documents,,5 pounds of paper work to prove the relation,,and now its over,,today we recieved a letter from them saying that my i-130 is denied,,deniedddddddddddd,,after 1 year and 3 weeks waiting,,and now we have 3 weeks to asppeal,,thats it,,iam done with it,,i dont know what to do anymore,,iam just ganna hurt my self so i dont have to worry about it anymore,what about the appeal?how long does it take to get an answer from verginia?another year or more,,screw all that,,we sent them a documents from my wife's doctor showing that she have a serious heart condetion,,and showing that she needs 7 surgery's in her back and shoulders,,pictures for both of us together since 2005,,credit cards in both our names,,latters from family members and friends,my phone bills since 2005,,there is 1700 calls out going and incoming ,,letter from hotels showing both names for 9 months,55 letters since 2005,,medical bills showing both names,,and they still denied it,,,iam done

mike_2007 - you have the right to appeal - so you shouldn't give up!!!! It's not over, because you still have an avenue open to you. I understand you are frustrated, but please try to calm down so that you have a clear head. Go for the appeal - what can it hurt????

Did you send all the documents they requested? Did you reply to all their requests for additional info and evidence? For what you wrote, they're denying your 130 for failure to prosecute it, meaning they think you didn't care about it no more.

Get yourself a lawyer make an informed decision... There's always hope.

Mike_2007, it isn't over til the fat lady sings. You still have a chance. More than likely there is something missing. Since you put the package together your overlooking something. You know all your details but are they included in the package? Take another look at it and from the perspective of not knowing anything about you or your wife. From their point of view which is they assume nothing and know nothing. If your wife can, have her take it to an immigration lawyer for review. I bet they will spot whats wrong with it in about two seconds. Bottom line is don't give up until all options are exhausted. The clock is ticking so get on the phone and get your wife moving.

From the gibberish he wrote, I believe he was denied because of suspected marriage fraud in the earlier marriage. Its interesting that he never brings this up. They never questioned him on the earlier marriage? I don't believe that. Just tell us, did they accuse you of marriage fraud; yes or no?

if your wife is not capable of this , then have her go to catholic social services to assist her in order to comply with the request made from uscis. You are nickling and diming and now it has cost you a denial.

He needs to tell us straight out if they accused him or found that he committed marriage fraud in the earlier marriage; a simple yes or no will suffice. Only then can we give "good advices". reason i ask is there is memo to I/o adjudicating i-130 to deny suspect i-130 petitions and not to leave it to i485 adjucicators to catch the fraud if it appears.

i really dont know,,we paid money to a good lawyer in san diago and he helped us to send everything together,,well we send 1-alot of pictures showing both of us together since 2005,letters from her family and friends ,3-credit cards showing both our names on the same card (cards was issued in 2005)4- hotel reciepts bcoz i lived in a hotel for 9 months and its sighned by the manager stated that we were together in the same room for 9 months.5-pictures with her family since 2005.6-more than 100 letters since late 2004.7-phone bills since 2005 more than 1700 outgoing and incoming calls.10-show her name on my phone bill(my account is under her name),medical plan under both names.11-stamped letters from her to my family .gifts and reciepts for the wedding ring.whatelse can we send?this is all we have,,and just to let u all know ,,all this and we were not husband and wife,,we got married when i was detained,,and we even mention it to them,,all this stuff when we were still dating

It could be something as simple as who ever looked at it didn't realize you were not in deportation proceedings when the marriage took place. The letter you received a month ago about that is suspicious. I think that should be brought to the attention of the lawyer. Its probably a simple oversight at the local office.

ok i got married to a u.s citizen in jordan,got cr-1 visa at the embassy in jordan,,entered the u.s on cr-1 in 2002,,recieved the 2 years green card ,2 years later we filed together to remove the condetion,i recieved a 1 year extention,after 1 year got the i-751 stamp on my passport,i stared spending too much time at work and we started fighting and having alotof problims and she filed for divorced bcoz she want it me to stopp working and sell the store,,so i said no and she kicked me out and she said that she have a boyfriend allready bcoz i was never home so i got mad and i left the house, i started dating my current wife ,and we fall in love and we decide it to live together,,so she stayed with me at the hotel,and then i moved to her house ,,so in september 2006 we decid it to go to mexico to meet her father and aunts to inform them about the marriage plan bcoz they didnt have status in the u.s ,,so we did went there for 6 or 7 hours and we went back to the boarder to re-enter and tbcoz there i was denied entery ,,bco the i-751 was no longer valid after the divorce,,my i-751 was valid until april 2007 and i was dened entery in september 2006,,so they detained me,,oh and then they said he told us he was a u.s citizen,so the judge asked them at the court why would a legal resident with valid i-751 will say u.s citizen,,and why would he leave anyway?so he order the officer to appear in court and he never did bcoz he's a liar and they addmit it later by telling the congress office ,,we gived him a break and dropped the charges bcoz mr.lopez(the immigration officer)wasn't sure if he said u.s citizen or (pr),but anyway,,the goverment and the judge agreed to dropp everything and specially bcoz i have a clean record,thats what the judge said,,he said iam not ganna waste my time on a case like this,,so i was allowed to withdraw my application for admition and i they actually gived e a ride to mexico like i never been in the u.s ,that what happen 4now,,and the judge wven said,,u dont lose ur status if u get dicorced ,,who told u this,,and i said the guys at the boarder and he got mad,,and he said no,,they just said this to detain u so u will lose ur status right the way,,thats all,so i went back here like i been in mexico since we went to visit er family and i didnt try to re-enter the u.s ,,,thats all 4now
