My I-130 was transfered from CSC to local office in Tampa on July 24th 07 for an interview after being originally filed on January 9th 07 and i havent heard anything yet so i made an infopass appointment,is it to early to have done so?

Do you mean I-130 plus adjustment of status packet? It's probably better to have an InfoPass appointment if nothing happens after 120 days from July 24th.

Hi Rough Neighbor, no it's just the I-130 as my AOS will be adjudicated by an IJ.

Do you have a lawyer to go through possible scenarios?

have you checked the processing times for your local office?

Yes i have a lawyer Aneri...i checked but they don't have the processing times for I-130 petitions.

hi caribbeanman,,,this is exactly what hapened with me,,,transferm i-130 from csc to local ofice,,,let me ask u this before i answer u,,,were u plased in removal proceeeding when u got married?and then u filed the i-130?

by the way aneri,,once the i-130 goes to the local office,,its no longer belong to the service center and ther processing also,,and the 120 days has nothing to do with it too,,,the case is at the local office,,they have ther own processing times,,and they dont post them for public,,specially the i-130

Yeah i was in removal proceedings before marriage, we were engaged for 2 years

Hi Caribe

Just be patient. make the info pass appt. 4 months isnt long for a i-130 in your situation.

Your case will just keep being continued in front of the IJ until that i-130 is approved. and its the only question he asks your lawyer . "Is i-130 approved yet?" once i-130 approved . then IJ will do adjudication on your package. peice of cake.

Im curious.. you were engaged for 2 years.... In hindsight, why you didnt get married, knowing that you could have been detained at anytime,which I see eventually did happen. Frown

Im glad everything is turning out ok for you.

We weren't ready at the time..she was finishing her MBA but looking at it now we should have...oh well.It's 10 months since i filed,OH you mean 4 months from the transfer??

hmmm,well thats why then,,ok what u will have to do ,,make this info pass,,and go there as early as u can ,,,and make sure when u go to the interview ,take everything with u,,i mean everything,,bcoz this is what hapened with me,,ther excuse was that we got married while i was in removal proceedind which i wasn't ,,and they dnied me bcoz they said (a visa potetion cann't be approved if the marriage took place while the benifeciery was in removal proceeding on or after 1986)but dont worry this is bull****,first not all cases are the same and second ur in the u.s my friend,,so dont worry ,,but the strange thing was i got that letter from the local office saying this **** and then they asked for evidence which we sent them and then thy denied it,,the strange thing is,,if they will denied it bcoz i was in removal proceeding,,why did they bother and asked for evidfence,,this is ur chancew my friend,,u can beat that by getting evidence,,i went thry the same setuation a month ago,,and this is what the most experience lowyers have told me,,to beat this setuation u have to make them believe the marriage was entered in a good faith,,and how ?is to show them everythinggggggggg,,i mean everything,,u know what,,dont mess ur info pass ,,bcoz that was the mistake i made,,i let it go until they denied me ,,,the lawyer said if u have went over there ,,they will never denied u,,,just go and dont worry about it,,its ganna be ok

We have ALOT of evidence to show them...i just wanna go and ask them when they expect i will be called for the interview.They sent me a letter confirming my current address and it said the have updated it in their systems and on my I-130 so i KNOW the file is there,i really just wanna find out what's the status on the case.

Hey Mike i have an infopass for 7:30am on monday but it says they will not let you in until 15mins before the interview so getting there really early would be a waste of time.

i understand all this,,and i know ur file is at the local office,,but what iam saying dont give them the chance to decide ur case,,u go there and c whats going on,,,so how was that exactly,,u filed to the csc or whatever cs and they transferm ur case to the local office?u said u have alot of things ,,did u send them the first time when u filed the i-130 or u just sent them the standard evidence?can u answer this plz

Mike i think if you show by CLEAR and CONVINCING evidence that the marriage is bona fide you shouldn't have a problem.

Yes i filed to CSC and they transfered it to local office..yes we sent standard evidence and MORE but we also have more evidence to show them when they call us fo the interview.

i agree with u my friend,,but u know that and i know that,,but they dont,,they think any1 who was in removal proceeding is going to re-marry to trick them and get green card,,thats all iam saying,dont get me wrong my friend,,its just i went thru the same setuation last month,,and the mistake i made was to let them send it to the local office,,,bcoz that was my fault,,bco i didnt send everything at the first time,,so they had to transferm the case to the local ofice and then request the evidence again,,and thats why iam asking u this ,,,but dont worry,,go to this info pass and if they need anything they will let u know ,,so dont worry about it ,,,i-130 is no big deal,,mine got denied bcoz it was a too much mess ,,so dont worry or compare ,,u will be fine man
