Hey there! I am concerned due to a letter from DHS we received this past week. It was a blue paper (form I-797) stating that we need to submit copies of documents verifying marriage. I amc onfused because we sent in a huge package of paperwork from rent agreement to car loan info, including pictures. I can't imagine what else they need. From everything I am reading I thought the Affidavits from two people attesting our marriage were optional. None of the paperwork I have read from DHS states that the affidavits are necessary. Can someone tell me if the affidavits are necessary with the I-751. These are the only things we didn't submit with our last packet in Januray. Thanks for any help!
Affidavits are optional. What time period did the documentation you submited in January cover? USCIS (not DHS, different agency, BTW) is looking for documentation from the date you received CPR until the date you submitted the I751. You say you submitted everything, but didn't list what that was. Tax returns, bank statements, insurance policies, credit card statements, utility bills?

First of all, sappyconifer, thank you so much for responding. I am now regretting not employing a lawyer for this second stage of the immigration process. We hried an immigration lawyer for the 130. Looking back it was actually mid December when we turned in packet. We did get a letter like 5-6 weeks later that they received the package and would be reviewing it. All of the items covered from our marriage in the fall of 2003 until that winter of 2005. Most of the things we submitted were from 2005. We did tax returns, bank statements, insurance policies (vehicle, health and life), utility bills, rent agreements, wedding pictures as well as intermittant pics over the last three years, marriage certificate.....Do you think it is unusual to recieve this blue paper request? There was no other note or white paper letter attached. This blue paper does have deadlines on it (September) and some warnings to not be late.
RFEs are not unusual, and you do need to respond within 30 days, I believe. It's possible that the information you provided has been separated from your file for some reason. The list you provided seems comprehensive enough on its face, but we don't know the details of your case. I'd send another set of the information as well as the Affidavits.
