hi,,i need help with my really strange and hard case ,,,and i will really appreciate if someone can answer me,i got married to a u.s citizen in the middle east in the of 2002,,i entered the u.s in 2003 on immigrant visa(cr1) ,in jun16-03 i recieved my pr card ,,the 2 years card,i start working,,and i file joinet tax return with my wife,,and 3 months before the expiration date on my pr card,,we went my wife and i and apply to remove the condetion on my green card,,the immigration send me a letter says that they cashed the money and they give me an extention for 1 year,,,a year later i went to my local immigration office to fallow up on my file,,and they told me that it still pending and they stamp my passport with the i-751 valid for 1 year,,until april 17-2007,on jun 2006,,two months after i got that stamped on my passport i got divorced,,so i got engaged again,,,and i moved to my new fiance's house and i chanbge my address,,and i never contacted an immigration attorney or even the immigration,,bcoz back then i didnt even know how all this work,,so anyway,in september i went with my fiance to mexico to visit her family and inform them that we were going to get married soon,,,so ,we stayed there for a couple of hours and then we left ,,we went to the boarder to re-enter the u.s and here is when all the problims start,,ok first they stopped me and asked me few questions ,,and then they asked me to enter inside the building,,and ther they told me that i lost my status in the u.s first bcoz i was divorced,,and then bcoz i made a false claim to be a u.s citizen,,which is a lie? i told them that i never said that iam a u.s citizen and they said dont worry about it,,maybe ur right,,just tell the judge that u were kidding,,and i said i wont bcoz i never said it,,and i have 4 ppl in the car with me heared saying pr,,and not u.s citizen,,but anyway,,they kept me there,,and then they put me in the detention center ,,in ther ,,my fiance and i got married,,and we hired a dum idiot lawyer who screwed me over,,first he told me ooh dont worry,,5 days and i will get u out,,and then 2 weeks later at my first court,,before the court he told me ,,ooh ,,the judge wont give u a billand i said well,,i thought u told me he wil in few days? and he said no ,ur an arriving alien ,,and u won't get a bill...so,,we entered the court room and the judge was really a nice person,,first he said,,why would he say he's a u.s citizen if he was giveing them hes country's passport,,and he doesn't have to lie bcoz hed was legal? it doesn't make since,,and thanks god he said that,,so then ,,he asked my attorney about my previous status ,,and the stupid jurk told him hat he doesn't know exactly what was my status or what type of visa i had when i entered the u.s ,,so the judge said ok we we will c,,2 weeks later at my second court the attorney didnt show up,,,so the judge said this to my wife ,,he said to her,,listen to me,,ur husband have a very clean record,,no criminal record,no feloneys ,,no traffic violation,,never been in presion or jail,so iam going to send the (DA)to thoes officers and c if they will dropp thoes charges againts ur husband,,bcoz that wont allowed him to enter the countrsy for 10 years,,so we said ok ,,,i called my attorney and i asked him why he didnt show up,and he said that he was sick,,so ,,he told me that he sent a motion to re-open my i-751 for the immigration and it got denied bcoz i was divorced,,,so i said ok ,,r u ganna come to the court next time and he promissed to do so,,so 2 weeks later i went to my final court,,and my stupid attorney was over the phone,,he didnt show up,,before this final court i got a letter from the court it says that i have been scheduled for a removal hearing and i will be illegible for 1-adjustment of status,,and 2-cancelation of removal,,and i dont remember the 3rd one..so anyway,,i entered the court room and the judge informed my wife that the goverment and him agreed to dismiss and drop the charges and the whole case,,and he told her not to worry,,he won't be deported or removal or anything,,but what iam going to do is sending him back to mexico and u will bring him back from there,,and they give me a paper sighned by him says (he was allowed to withdraw hes application for addmition)and then waived by both..........so anyway they put me back in mexico ,,and iam jordanian citizen??????? and my wife have filed the i-130 and the i-29f for me,,and it been pending since jan-17-2007,,and all i got is the first (NOA),,so now i dont know how iam ganna process in mexico? i dont have a legal status in mexico? and is that detention part well hurt me to get back to the state? my wife had a heart condetion and she needs me ?what should i do?

I'm having trouble believing that you were deported to a country where you are not a citizen? Has anyone else heard of this?????

I have such a hard time reading his post, I started, but I got squared eyes, not very structured.
So, I didn’t read his post, but Proud USC, yes you can get deported to a third party country, if you don’t fulfill the requirements to stay in the US, but you own country is for some reason instable or unsafe.

Thanks, Vegado - my eyes are still crossed from reading his post - LOL. I'll have to study up on this one. He says he's from Jordan - his wife's family is in Mexico - maybe that's why they chose Mexico? I don't know - I need to get smarter on all of this!!!

But Mexico accepts only Mexicans, so any non-Mexicans are checked against government watch lists as a potential security or criminal threat.

I didn't want to copy the whole article, but you can read it at the above url. I haven't seen anywhere (yet) where it's okay for the US to deport non-Mexicans to Mexico (which seems to be the situation of the OP).

Your case sounds a lot like the Toro-Romero case. It may be a problem on determining if you truly were an arriving alien or not. This is highly technical immigration law. You need a real good lawyer, one with experience, not the guy with the yellow pages ad. Get an attorney and don't rely on this forum for advice, this is not the place to get legal information.

- THIS IS NOT LEGAL ADVICE-

It's pretty clear to me. Stupidity and ignorance of the immigration laws. It's really unnerving how foreigners are ignoring the laws although many many could have avoided the situation they find themelves in because of simple stupidity and negligence.
OP, you neglected to see through your immigration process. By getting divorced and getting engaged with another woman you cancelled the immigration process and neglected the consequences of thereof. You have only yourself to blame. Consider what happened a lesson to smarten up a bit and learn about immigration and start taking it seriously.

As the OP says he travelled to Mexico and was detained on the border. Since he was out of status in the US, the border immigration couldn't let him back in because he didn't have a visa to enter the US. Since he was in Mexico, it was a natural thing for immigration to keep him in Mexico.

Clear as a whistle.

ok once again ty guys for respond,1- proudusc why is it to hard for u to believe that iam from jordan? 2-i said it once before that i was'nt deported,,when i left the u.s and went to mexico ,,and then i got in that trouble ,,the judge and the immigration (allowed me to withdraw my application for addmition)another word ,,the case was dissmesed and wiped ,,like it never happened,,i was'nt deported,,they said we will act like u never crossed the boarder ,,and never got stopped,,and bcoz u were in mexico last time when u tryed to re-enter the u.s ,so we r going to put u back there like u never crossed to the u.s,got it? no deportation was involved or removal on my record...and the second the what credibility are u talking about? i dont understand? i mean i was a legal immigrant in 2003 on immigrant visa? no criminal record,no feloneys?no traffic tickits? never been in jail in my whole life,,i file tax return for 3 years with my x-wife? but the marriage didnt work out? just like other people ,,they get divorced and re-married again? do u want me to lie and trick the goverment by telling them that iam happy and still married?no ,,i told them the truth, iam not seeking an immigration benifets by marrieng a u.s citizen for a green card? if i want it that why whould i get divorced after 4 years marriage and after i had the i-751 stamped allready on my passport? its just something happen,,and things happen all the time yes,,,and yes i learn from my mistakes iperson,,,and i appriciate everything guys,,,talk to u guys soon

Mike or whatever name you have, you're too confusing as I imagine you're confused yourself.
You left the US on your own accord, so there's no question about deportation. You have to be in the country to get deported. You tried to re enter the US and you were denied, that is why your application for admission was denied. Nothing was dismissed, there was no case whatsoever. Unless you were trying to pass as an American citizen, which I think you did, and I guess they dismissed that charge as if you never said it.

It looks like I know better what took place with you than you yourself.

In any case, in the future, learn that it's wise to respect the immigration laws. Too bad so many people learn on their mistakes and pay dearly for it.
There's nothing wrong with getting divorced and remarrying. What is wrong is ignoring the immigration laws and lacking any information about them whatsoever. It's really unnerving how stupid people are.

If only stupidity had wings...

First of all I am an immigrant myself and because I know what the process looks like it's really upsetting to see people completely ignoring the privilages given to them.
And second you should learn how to spell and write intelligent full sentences.
And third don't lie you had a valid i-751 extention when you didn't have one because you were divorced. When you divorce the first AOS application is invalid and you have to reapply if you remarry but you didn't know that did you?
You said earlier that you were going by car and I am guessing you thought you'd show your driver's licence (not your Jordanian passport- which you probably didn't even have with you now did you?) and pretend you are an American.
How dumb are you? Do you think that immigration officers are as dumb as you?
You are lucky they dismissed it because there were many people who did exactly the same thing and were barred from entering the US for ever.

You deserve what happened to you because of your stupidity and ignorance of the immigration laws.

So where are you now Mike? Which country are you currently at this moment?

Btw, my forum id does not reveal my gender so stop assuming I am a mr because I might not be.
I also suspect you committed marriage fraud in your first marriage and when it didn't work out (the lady must have gotten too impatient), you quickly remarried.
Can you tell me at what point you got married again? Was it before or after the stint on the border? When you were detained which i-751 was valid: the one from the first marriage or the second one?
Let's see who is stupid here.

i dont care what u suspect or not,,,ur no one,,ur nothing,,not u ,,and not the goverment,,and the judge can do anything about ppl getting re-married,,the only thing they can do is to delay the process?and who care,,bcoz sooner or later the'r ganna have to prove it,,and c ,i dont have to answer u ,,but no,i didnt marry to get a green card..i dont care about the stupid card,,its nice to be legal,,but who care about the card,,i love my wife ,,and i have the money to open up a big business that any country in the world will kiss my *** to be there...but the thing is that i wanna be with my wife ,,and that's it...and try to learn not to play with ppl feelings next time ,,,and it doesn't matter if ur a male or felame,,,try to respict ppl so they can try to respict u back,,bcoz if u dont have respict for ppl,,then u dont have respict for ur self,,,just run it in ur mind,,if i want it to marry her for the stupid card or the status ,,i could marry her while i was still in the u.s,,,before crossing,,and yes i did know about that,,if this is ur excuse that i didnt know ,,and yes,,we were liveing together at the same house for 10 months,,,who care about the card,,,if u did in ur past,,i dont,,and i never did,,i just care about my poor wife,,thats all...
