My brother has been living in the United States since he was 3. He is now 27 years old. When he was about 21 years old, he was diagnosed with schizoaffective disorder and has experienced numerous problems with the law. He has collected a number misdemeaner charges over the years and his been back and forth between jail and a mental health center over the past year. On top of this, he apparently had an escape attempt during one of his trials.
My brother is not a U.S. citizen. I am, and I have recently petitioned by parents, and they finally received their green cards (I am 22 years old). But before his mental illness really took over his life, my brother had no problems with the law, was a fine student and had much to offer to society. I just want my brother to get the help he needs, but it looks like he is at risk of being deported (meaning it's almost certain). I realize that he has been living here illegally, but it's been 24 years - I don't want him to leave...
My question is, under these circumstances, is there any way that he will be able to stay in the States or come back after he has been deported? This is incredibly confusing situation for my family, and even a little advice or suggestions would help a great deal. And feel free to ask me more questions. Thank you so much!
Beloved Hope - Sorry to hear about your brother. The best thing you can do is hire a good attorney. Since this is a medical condition and if can be treated and not available in the country you are from, that can be effectively presented to USCIS and they will consider it.
Again, I am not a lawyer so please consult with legal expert.
SonofMichael - Beloved Hope is not one them fraudsters. He/She deems legit and respectful of law. So lets treat him/her with respect.

Yes I agree; she knows how to show some freaking respect and so she deserves respect in return. The issue needs to be handled by an attorney. It sounds like he has some major problems that has to be worked on. Escaping custody is a felony. So I believe the road to citizenship may be difficult.

I know what you feel for your brother beloved hope, but he will surely get deported and he'll get a 10 year barr or permanent barr. Not because of his mental illness.
He is here ilegally and he comitted crimes ( what are those crimes btw?)
It will be a very slim chance even you petition him under f4 category ( due to this crimes). Even if he get that slim chance it will be a very long wait due to the 10 years barr ,and the petion is under f4 category.

There won't be any room because we have too many of you illegals, criminals, fraudsters, VAWA cheaters...here. So the boat won't have any room for upstanding US Citizens like us. And dumbo naturally born US citizen can never be deported.
