What is the statue of limitation for presenting false document to INS. How long do INS have to prosecute anybody for presenting false document.

I don't think there is a statue of limitation on immigration fraud. I'm quite sure you'll have this problem for life, and beyond if you have children.



The only thing un-American about America, is the USCIS.

Its the federal government. They can take as much time as they want. But, as time goes on their interest in what ever it is you did will diminish. What did you do?

But there is always statue of limitation...after which the person cannot be prosecuted even if the government want to try the person.

Someone in an attempt to get LPR used false name/documents. Now he is using his real name to try and get his LPR. Both names are in his record with INS and FBI.

He presented the false document for LPR application more that 10 years ago and went for finger-print at ASC in 2001.

Does anybody know after how many years that someone cannot be prosecute for false document because of statue of limitation.

The government can procecute as well as deport you when you go for your interview. DHS will have your fingerprints on file and they will get a match.

Wow now you call this a mistake. He knowingly and willfully presented a false document to obtain Greencard and you are saying it is a MISTAKE. What if someone were to kill you and then say it was a mistake? Should that person be forgiven?

I only know of murder cases that don't have statue of limitation but others like presenting false document must have a statue of limitation.

naija, the issue is the person is still receiving benefit today for the false representation years back. This is an issue of status within the country so its different than criminal, tort, etc. In essence there is no statute. A while back there was a doctor who probably got deported for making one false statement concerning his marital status 20 yrs prior. He was a doctor and it was only an issue of his marital status. How much more severe is this? Like I said. Better run.

Giving false document to USCIS is a Fraud.

You need some legal advice from a lawyer
to get an accurate answer for your question.
