my husband who is from africa we just got married in july and he went to jail at the end of july and was suppose to be release from jail 9/23/06 which he was because of ins but will out a trial moved him to new mexico for trial for deportation which he has one 11/13/06 i hope to god he isnt deported i realize how people feel about drinking and driving because my nephew was killed by a drunk driver and to be considered drinking and driving he can have only 1 drink. i hopoe everything works out for you and if you get probation you shouldn't have a problem but the jail time will get you and the only reason they want to deport ernesto because he didn't go back 2001. because he is marred to me and and has a son who will need him i really believe ins should send him back home with his family in massachusetts because we miss him.

My husband was in jail for dui and was suppose to be release 9/23/06. but never was because he return to africa in 2001. which i understand its a ins law but i am married to him and i just had his son 9/29/06. but then instead of keeping him in the same place they had sent him to jail in new mexico which we live in massachusetts where i can't even send him pictures of his son. and sent him there without an trial. i just don't understand why they sent him so far away especially from his family. and I am trying to send in papers for him because i don't want him deported at all which i shouldn't think he would especially being married to us citizen we were also together 3 years before we gotr married. and he had a lawyer a free one but when he was moved to new mexico they couldn't help him in anyway.

What crime did he commit? Was he in legal status at the time of the arrest? How long did he actually serve in jail?

it will only be a matter of time before the OP chugs down some booze, hops in his car and flattens out a family, then he will try to blame the police that arrest his sorry a$$.

I received a letter yesterday that my court date was on 11/13/2006. I inquired about it and found out they sent me the wrong date. I am still waiting for the discovery and pre-trial date.

My lawyer got the court date notice for 11/27/06 but I haven't received it yet. You will be surprised to know that discovery (police report) has not been received yet. As per the lawyer, pre-trial date will be postponed and an order by judge will be issued to state police to produce the discovery as soon as possible with time limit.

The case was postponed because no discovery was delivered by state police. I showed the receipt of payment for discovery and requested a speedy trial. I will be notified about new date in mail and a court notice to produce discovery will be sent to the county police department.

Who's decision was it to have the case continued?

I hope the OP clearly understands that there's little use in discussing the details of a trial because they have no impact on immigration matters. Maybe he feels compelled to discuss his trial and doesn't mind spending time doing that, but these issues immaterial in the context of immigration.
