One of my buddies, a USC of 20 years, was arrested, stripped of Citizenship and dropped off the helicopter over Mexico deserts for sticking out his tongue in public.

But each individual case is different. For legal advise consult an attorney specializing in similar cases.

Well,
to official immigration rule and law is,in order to become U.S. citizen you have to show u lived in the US for the past years ever since getting to this country lawfully, without breaking any law (besides tarrfic violation),and showing good moral conduct.

Any arrest can be pulled by anyone, even by me and other members,as long as we have your full name.Very simple actually. NOTHING is sealed in the United States.

So its like on a job application, there is question, that says "have u ever been arrested" sometimes it only asked "have u ever been charged with a crime"

but for the immigration there is a basic rule, have u been lawfully in this country with good moral conduct???

You might face problems, and I would consult an attorney, you might be better off not even applying.Because in some cases they can even deport you,for commiting in a crime in the US as a resident alien...only in worst cases though.

but if it was a silly thing like stealing a cd or so..i think its not big of a deal.

Any arrest, small, large, expunged, sealed, pardoned will come up on the FBI check and it will be viewed as fraudulent if it is not revealed beforehand.

Unless there was no arrest to begin with.

In case of OP and other poster:

read specific chapters of INA dealing with Citizenship eligibility (there are only handful of chapters and pages).

also, read Sec. 212, 237 , 238 and 96 Reform Act of INA to find out answers to your questions re: arrests, convictions and their effects on LPR status.

For legal advise consult an immigration attorney.

Hi Karma,

Why were you arrested for calling the cops on your husband? Btw, I don't think Barbwire will respond. He/she only posted only once on this forum nearly a year ago.

It happened 10 years ago but I’m concerned it might still affect me when applying for citizenship

Hi Karma,

If you were charged with a misdemeanor 10 years ago, I don't think you'll have any problems getting your citizenship. Perhaps you should run your question by a qualified immigration attorney just to make certain. Good luck.

No effect, unless you lie about it.

What is the consequence if you lie about it.

Yes, records can be sealed for adults in New York, not sure about anywhere else.

If you lie, those are grounds for denial, if material, and criminal prosecution for a variety of offenses.
