A student from the Republic of Georgia has been in America for seven years attending school. Two years ago she changed her visa to tha H 1. She was recently laid off from work with about 500 other people. She is married to an immigrant with a H 4 visa. She was laid off about six weeks before her baby is due. Circumstances at this time are not positive to seek new employment. Her baby will become a US Citizen. How will this affect her status? Please give us advice as the best way to be legal and remain in America. We need help very much and now.

There is no such thing as immigrant with H4 status and more problematic is the fact that though you have an stamped H1B, you are technically on the brink of being out of status.
The child is sure to become US citizen,but the child can only petition for the parents once s/he reached the age of 21.In the meantime if you decide to go back to your country,the child remains US citizen and there has been cases on this matter several times,that parents cannot "capitalize" on their US citizen child to stay.Best of luck anyway!
