Quick history:

German expat married USC in 1998.

Unconditional residence granted 2001 (ie, conditions were successfully removed).

Seperated from USC spouse in 2005.

Divorce finalized 2006.

Now, I am disabled, but I am unable to get SSI or disabelity because I do not have enough "quarters". I worked from 1998 to 2004 (with gaps for health issues and for taking care of sick spouse) before I became disabeled in 2005. I tried to get food help and was refused but was eventualy told that I would have to try to sue my ex spose in court instead for a maintenance type fo thing.

I have read Stump case, vaguely, but am not sure how to go ahead. Of course I don't really want to have exspose support me, but with no income I don't have many choices left to me. I would prefer not to return to Germany because I have been here since 1998 (always legally)
and have acomplished a home and friends.

Does anyone have any advice for me? Have there been any more lawsuits supporting the Stump decision?

in germany u can go to hartz 4! Its 350 euros a month plus ur rent will be paid and heating costs. Might be better than going to the dogs here.

I have found several cases since Stump - my lawyer is going again and filing in Federral Court.
