Hi HP: I'm not an expert on the H1-B visa status, but I don't believe that you wiould be able to open a restaurant. It is my understanding that an H1-B visa allows you to work in America ONLY with the company that sponored you for the visa. Furthermore, I know that H1-B is a non-immigrant visa that has a three-year validity, and that it can be renewed for a further three-year period (six years in total). Even from a purely practical perspective, it would seem unwise for you to contemplate starting any business venture (in this case a restaurant) when you have a non-immigrant status. Furthermore, if you were to work for any organization, other than the company that sponsored you, I believe that you would violate your H1-B status and be subject to deportation. Have you investigated the possibility of obtaining permanent residency, perhaps through sponsorship by the company for which you now work in H1-B status?

You may own a business even on H-1B as long as you are not gainfully employed at your business. If you want to be employed at your business you can obtain concurrent H-1B.

Good luck.
