Hi,
I need help. Can someone guide me please. Situation is like this:-
Conditional GC expires Aug 11, 2005.
I-751 has to be filed by May 11, 2005 the earliest.
The person has to leave the country on May 1st, 2005 for study out side USA where semester starts May 3, 2005 & ends Aug 19, 2005.That means his GC expires, while he is out side USA.
Is it possible for him to get his passport stamped with extention of residency at the US embassy abroad or he can send his passport with I-797 notice of action to CIS office in USA by mail & get it stamped. The last option I can think for him is that he should come back to USA before expiry & get it stamped & go back. In last option he will miss his classes besides air fare.
Any comments/sugestions will be highly appreciated please.

Hi,

Has he someone to mail things for him and pick up his mail the US ?
If yes... here is what can be done. "Student" should prepare all the documents to file I-751, and ask the person he trusts to send it after May 11. He will receive NOA. The NOA should be sent to the "student". Notice of Action EXTENDS GC for one year (till Aug 11, 2006). The "student" will be able to enter the US with passport, NOA and expired GC.
No need for the stamp.

Hi Aneri,

Thank u very much for the excelent solution to the serious problem. Yes, his parents are here & they can do the mailing for him. I admire ur help. The student himself is also extending his appreciation to u. We never knew that NOA does extend GC for one year. Now we are relaxed that he can enter USA with NOA, Passport & expired GC during his semester break or I-751 interview, if needed.
I have one additional question. Do u suggest he should file change of address AR-11, while he is in college out side USA?
We will appreciate ur reply in this regard.

Hi vito....

If he is maintaining the postal address in united states and temporary residing at other address for job or education purpose, in that case he doesn't need to file AR 11 ... if mails are still going to come to the same address then there is no need to file AR 11 ...Good luck...Pasha
