And I would appreciate any competent advice and/or comments.

But to add...I knopw that I should file form I-102 to get a replacement, but my wife, her parents, nor her aunt (whom she entered with) can narrow down US entry only to between 1984-1986. If I file the I-102 form, will they only search the exact date, or will they do a thorough search in a time period if stated on explanation?

Has anyone else been thru a similar situation...please help!

You can file FOIA request. The response from USCIS may provide you the exact date of entry. Go to http://uscis.gov/graphics/aboutus/foia/request.htm

I think you can request a replacement from CIS, check the website under how do I section.

Hello,
Mr. Rich,
I am in the same situation. I came here on a tourist visa and overstayed. I lost all my papers in 1997. I have been here for a little over 16 years. I am married to a US Citizen since 2000 and have USC children. We went to my adjustment hearing last month and I was told to come back with proof of entry.
Our marriage was certified (I think the officer explained that he believes our marriage is real in the eyes of USCIS) and all other stipulations were taken care of at the adjustment hearing. The officer mentioned that he has signed off all the other requirements, except the proof of entry.
I have filed FOIA with USCIS and a new I-102. My previous I-102, which was submitted with my adjustment application, was denied as my lawyer at that time did not know a whole lot and neither did I.
I am doing this process for finding my I-94 myself.
Also, I have mailed the US Consulate where I was originally given the Visa, to get any records of the visa, if available. If you go this route, please contact your congressman and state senator, to have their immigration liaison follow up on the process.
If you go the FOIA route, use the USCIS form for the FOIA req. to USCIS, but also make requests to US Customs and Border protection and US State department using forms available from their website. Make sure each form has a FOIA release statement or privacy release statement that is signed and notarized.
Good luck on your search for I-94 and please let me know if any methods are successful, I will do likewise.
