Hi,thank you for both of you to answr my previous question.regarding about file I-485(AOS),Do I need medical exam paper together when I file it? or I can mail them later?
since INS said I have to file my papers within'30days I really don't have that much time and I really wants to done my paperwork right this time.
Mohan,here is exaxtly what they say on my IJ order.

"visa waiver pilot alien-not subject to removal proceeding" and appeal was waived.

my order doesn'y say anything about 10yrs bar or nothing.I also recieved letter from prosecutor from INS said error was made in issuing the notice to appear.
Reason: I entered US under the visa waiver pilot program and my passport showing WT admission stamp.

I really dont understand your question. I mentioned the ten year ban as you mentioned I-601. If you are filing the I-601 that is the waiver from 10 year ban!

Check the forum. As long as you have your I-485 and I-601 in with the INS, you can send for the medical examination and other stuff later. You just need a fee stam from the INS that you did file everything on time!

If you dont have time to present an argument for the I 601 right now, you can write a supplimental brief later! I would also suggest consulting a good attorney.

But work on the I601 yourself, as you can prove the hardships on your husband/wife yourself better than any attorney!

so u don't have cencellation of removal granted. you were issued NTA in error and IJ corrected that mistake and your deportation proceedings were terminated, there is no NTA against you. You are now overstayed but you can file for AOS .You have need medical exam also with your AOS package and also Fees for finger prints. Down the line when you will be called for interview you need waiver for overstay also.
is there anything more into it? why the right of appeal is waived? right of appeal is only waived if they gave you voluntary departure. Termination of removal proceedings should not have appeal waived. waiver of appeal means there is no automatic stay. check again your paperwork.
