However, if they did not use welfare, they out to pay $50 per day for every single day they over stayed provided they did not file any taxes and worked on cash. If they filed taxes and no welfare, they will have to pay $25 per day.
Any person who entered illegally by crossing the border will have to pay $200,000 to gain citizenship or else will be deported. No court date, no due process. A swift and just action.
If they cannot pay $200K right away, they will sign a promissory note to US Govt and pay every month some agreed amount, they will report back to Immigration Office every month. If they miss an appointment, they will be deported right away.

All of this would clog the courts till dooms day. Take care of the problem at its source. Remove the insensitive to come and they will stop. No jobs. Constitutional interpretation not required.
In the above, only the 5th and 7th amendments would actually apply. There are many provisions of law where fine amounts are duration or circumstantially based and adjusted.
I'd toss the $200 k fine for citizenship. Citizenship is not for sale. The jail times should be replaced with immediate deportation and lifetime ban. No sense over crowding our prisons.
The illegal can't get welfare, no need to worry about that. Perhaps a restitution judgment for welfare payments of the children against the parents and concurrent 3 or 5 yr ban with satisfaction of judgment.
For the marriage fraud cases incur a civil judgment to pay back that which was stolen and a 3 yr ban to commence upon satisfaction of judgment.

No hearing is required to remove an American Citizen from their home when a residency seeker wishes to dispose of their petitioner. Why have deportation hearings at all?

Since USC life-years are stolen in the marriage fraud which cannot be paid back, the equivalent number of years they have to serve in jail in addition to current 5-year term as stated by the law. Also, as SOM pointed out, we will make it mandatory to enforce it.

Agree more than 100%. I think we should not deport illegals and marriage fraudsters just like that. Also, taking into account Davdah's point of clogging the prison, we should force them to work on Government plant something like farms or factory, we will treat them humanely giving them food and shelter, but they will basically work free for X number of years instead of spending time in jail and once their time is up we will deport them. This way they will pay the price for breaking the law and US Govt will benefit for any welfare their kids were on or any other way they personally benefited like working cash job and taking away that job from USC.
