exactly davdah,,thats exactly what i was thinking about,,if it was serious they would have call someone on her to pick her up,,unless if they dont have authoroty to call bco the'r immigration?thats the question if they do have the authoroty to call other agency's or the local police to pick her up or not?if not ,,then i dont know the answer,,and if they do and they didnt ,,then i dont think its serious,,bcoz she been getting stopped for almost 9 months ,,everytime she crossed,,and she go there every weekend,,so thats like more than 100 times they have stopped her,and the same thing ,,they just give her her licence back and say have a nice day,,the last time they stopped her and when he come back with her licence she asked him if he can find out for her whats going on,,he went inside and when he come back he said ,,well,,,it looks like u have a warrant?and she said what warrant?and he said i dont know ,,have u ever called on somebody else?and she said no,,and then he said ,,will,,have somebody called on u ,,and she said that she doesnt have any problims with anybody or with the law,,and then he said well,,i dont know then,,,thats what happen,,but it could be that they have her name since they kept her inside when she was with her fiance back then whn they detained him,,bcoz they took her finger prints back then,,but she was released also bcoz they told her that there is snothing againts her on her record and shes a u.s citizen ,,,but iam still woundering,,if there is something serious,,can they call on her or no while shes stopped there? or they will just wait until she get in troube some how or what?thnx alot

I would think if it was a big deal they would have held her. I can't say for sure how much there is in the way of cooperation bewteen law enforcement agencies that is required. I would imagine there are rules that state they must detain a person if the criminal seriosness is high enough. Or it could be just guilt through association. Since she was present with the fiancee when he had his problem they flagged her for nothing other than that. Another possible direction to take is to call the local border patrol office and see if they will give out any info on it. If that doesn't work, then maybe its time to try the police.

thnx alot,,,do u know where can she call or the get the numbers from?bcoz she tried the senator and her congress man and they want her to write and all that and they said it will take them 4 weeks to send it there and not for sure,,,who can she call and complain over the phone and they may be able to pull her record also and tell her what's going on,,bcoz i dont c this right to be stopped everytime for an hour and at the end they dont even tell u whats going on,,he told her that he doesn't know,,well,,if he doeasn't knomw what did he stopped her then?

Calling a senator or congressman may be a little too high up the political food chain. If border patrol won't disclose or they really don't know then you may very well have to call into the police dpt and ask them what's going on. I would try having someone else make the call first not from her house.

ur right ,,and i will tell her to do that,,and i understand what u mean,,to avoid any possible arrest if they trace thw phone ,,she have never been in any kind of trouble with the law ,but if it was something serious ,,do u think the police wil wait until she calls and trace the call or she appear somewere or they will just go to her house?and another question,,do they normally send letters for her from the police department or no? bcoz when she checked her local court files online,,there is nothing but the previous divorce,,and the dmv records are clean also

I doubt any letter would have been sent unless it was for something like a traffic ticket. For anything else they just wait until they catch the person. If her son called and they refered him to the court records, provided they did run a check, then it may be nothing at all. Perhaps from that one incident where she happened to be with her fiancee when they grabbed him. You may want to ask him how much time lapsed from the time he gave her name to them until they told him to check the court records. If it was an immediate response they didn't check at all. If it seemed to him they were checking something then they may have.

well no,,when her son called the police he explained what happen at the boarder and the police officer didnt really care,,he just said ,,well here is the phone number for the court and go ahead and call them or logg on online and check it ,thats what happen ,and whe she looked online on and run her drivers licence online there was nothing,,and also she logged on ,on the criminal court record for her county and also nothing ,,,

Since they have that available to check on line it may be nothing at all. The on line check she did, was there info given that stated what sort of records were reviewed for a match? It may have only covered certain areas, traffic, domestic, etc..

well the court records ,,,she run her name in the civil data cases and then the traffic and the criminal data in her counrt also,,and there is nothing in her name exept the divorced records,,and the dmv the same ,,one ticket in 2005 but it was paid

hereis what happen ,,she paid an attorney 500 dolars ad did some research and he told her,,ther is no record in any court,,no dmv record,,and no problims with the police?but he doesnt know what did they told her there is a warrant on her name,,he said there is nothing in her name ?

It must be the car then. When you pass the border they run the plate. If it comes up with a hit they probably have to investigate. Even if the note says its registered to John Doe and a women is driving it they still follow protocol. It might be time to get a new car or call the DMV and get new plates. Just say the old ones fell off or something.

hmmmm ,,i dont thins so davdah,,all this started since that day she wasd with her fiance at the same boarder and they finger print her,,but when they released her that day they told her that shes ok bcoz she a u.s citizen and bcoz she have a clean record,,but then they started stopping her everytime she crossed ,,and 3 too long ago she did bought a new car and she doesnt even her her new plates on yet,,but when ever the machine beebed and flash red only when they run her driver licence on the computer,,not before,,so i dont know ??????what do u think

If the new car only has the temp sticker in the window they are probably running that and seeing her name at the same time. At the border crossing she uses do they always check id? In San Ydisdro many times they just ask your citizenship and waive you through. I guess it depends on appearance as well. If you look 'American' they are not as curious about you.

The only thing I can think of is the border patrol may keep a database of persons they are interested in for what ever reason. If what happened before caused her to be flagged there may not be a lot you can do. Since they have free reign to inspect people at will she may have to tolerate it until they are happy she isn't up to something. I wouldn't expect anyone including the senator to even admit that such a thing exists but I'm sure it does.

no she doesnt look american,,she looks pure mexican ,,but yes ur right,,thats bottom line,,she tryed courts,police,dmv,and no record,,she got a copy of her background check online,,and nothing but her previous divorce,,so i guess they flaged her bcoz of what happen,,but the strange thing that the immigration officer didnt even know unless if he didnt wanna tell her,,bcoz first he said,,it looks like u have a warrant,,and when she asked him from wh,he goes,,will,,have u report anybody?and she said no,,and then he said,,have somebody report u?and she said,,will u tell me?and then he said i dont know ,,check with the police?so she did and everything was clear,,but she's still worry about 2 things,,,why did they arrested her son,,and r they going to arrest her someday or they will keep doing the same thing and let her go like always

When they arrested her son was he charged with anything? Assuming he was merandized there should be a record of the incident that you can get. It should provide a clue as to why they keep stopping her. If he was simply detained it may be difficult to get a record of it. When the border agents asked her about any warrents it may have been a trick question. They probably asked since she is one their 'watched' people and assumed she may have other possible criminal connections. Similar to when you get stopped by the police they may ask the same question just to see how you respond.

If she is not pulled aside every time then their interest level is probably dropping. Does it seem she has been able to get through more often now without inspection as opposed to right after the incident took place?
