What will be the repercussion if there is two I-140 filed for me and my husband by the same employer? My husband is a nurse and I'm a computer programmer, and he's interested to get both us. I came here in a business visa and was given 9 months by the INS to stay here. The employer told us that it will be more easier for us to get approved since we are both professional and it will also speed up the process of getting our child from the Philippines.

It is normal and there is no harm in it. Actually both of you have double chances now. If one I-140 is not approved and the other is approved still both of you will get permanent residency here.

In reference to my first question, I'm planning to go back to our country by applying for an Advance Parole while I have a pending petition (I-140 filed concurrently with I-485 and EAD) so I can get my baby. What are the options that I can take to go back here in US with my baby? Do I need to submit a separate application for my baby since she's in the Philippines?

Your baby will need to apply for a green card; however, the I-485 cannot be filed while she is abroad.

If you are on an H-1B or L-1 visa, the easiest way to bring her here is to apply for an H-4/L-2 visa for her, then file an I-485 for her at the same time as you and your husband file. BCIS prefers that all family members be processed together (i.e, principal, spouse, and minor children.)
