Hi All, my husband used to tell me he uses this site to get help with immigration issue and now i want to get advice here. I am a USC and we married after dating for 4 years. Part of me married him becase i loved him, but i also loved him because he is such a good guy and has so much potential that i felt bad that he wasnt able to do anything. plus he had so many responsibilities, etc. Anyways, we married and to this date i love him alot, but we come from very different backgrounds and cultures. We have been trying to make our marriage work, but we just cant give up so much of our families to be with eachother. so we are thinking about splitting up, or i am thinking about it more than he.

We married and he got his green card, then we applied for his condition to get removed from his 2 year green card and that process went well. my question is, will he be ok in terms of his status in this country if we divorce? Will he lose this green card or anything thing like that or have to move back to his home country? Will he have trouble traveling outside the country, working, etc? I am not very familiar with this issues becuase he usually did the research and talked to the lawyer and kept me in the loop. I just want to make sure he will be ok in terms of his status before i file for divorce. any advice or direction or suggestions would be greatly appreciated. thanks much in advance.

Hi Water and welcome to ILW Smile

No a divorce will not affect his Green card or status here in the US since he has the 10yr one now.

A divorce will not affect him traveling nor carrying on working here in the US. (as long as he has an up to date passport and/or visa's if required for international flights)

Yes you are right, he won't be able to apply for Citizenship at 3 yrs , he will have to wait until 5 yrs (-90 days) from the date he received his Conditional Green card if you separate or divorce before the Oath Ceremony.

If he intends on staying out of the US for long periods of time he will need to read the guidelines on that too, as too much time outside the US could mean he could lose the GC or have problems getting back in without the necessary paperwork. I wasn't sure whether you were asking about working abroad or here, so just in case.

I'm sorry you guys can't manage to sort things out especially as you still love each other.
I wish you both the best though, whatever happens.

This can't be real! A women not wanting to stick it to the husband? I never heard of such a thing. Once the feminazis see this post they will be protesting at your door step.

That, or perhaps he isn't the one to get financially crucified in settlement.

You voted democrat. This country is not worth sneaking into any more.

Surprisingly it does happen davdah. I've known people who have divorced and stayed on good terms. A bit unusual but it does happen.

I still think it has more to do with who will take the hit if it goes to the issue of entitlement.

What a horse sh it. All of you guys seriously believe this to be the case? This is a pretending post swapping seats to perpetrate the fraud. For the sake of argument if one were to believe this to be the case, no one in their right mind will post it. They will confer with their attorney as stated guy is already talking to an attorney. This really cracks me up. Lot of fake posts have been popping up since yesterday.

This happens only when there is no lottery to win by exploiting so-called rights of entitlement. Show me poor people divorced and I'll show you friends. Show me wealthy divorced and the bitterness is life long.
