Hi Kalla, So any new news from the FBI or INS yet about your case ? Well me and you are in the same immigration boat. Waiting for a simple Name check from FBI for the past 30 months. So let me tell you something which I have done so far and let me know if you are doing something different about your green-card process. My receipt date is 07/25/02 (I believe your case was in Sept 2002) what is it with this 2002 cases? How come people who applied in 2004 are getting green-cards and we are waiting? Anyway I have faxed my information to FBI ohh!!!!!!!!! 4 times till now about my case and I got one response from Mr David Hardy (FBI) via email. Did you get that email too? At the same time I sent letter to the Philly INS office got a reply saying they don't have my file. (I was just telling them to check my file from Chicago and do some investigation about my case). In addition I sent a certified letter to District director of Chicago to look in to my case. I got a response that they will answer me in 90 days. Still pending and waiting. Next week I am faxing a request of FOIPA for the FBI hope they will respond. Have you faxed FOIPA? Did they reply back? Anyway In Feb I will start talking to a congressman or a senator here in PA. So what have you done about your case that I have not done yet? Any advise will be appreciated. By the way did it help talking to a congressman for you? We can learn from each other's case right? Let me know. Currently I am looking for a good lawyer in Philly since I am planning on a trip to India with a advance parole. By the way what's your country of origin? Thanks man.
Raju, Same old no news as of today. Hardy actually sent me an e-mail telling me that they had not received a request by USCIS on my behalf! I wrote a letter to the NYC district office director, I am waiting on that one also. I sent a fax to the FBI regarding the FOIPA and got a "No record" response 12 days after in the mail. In your case, since the FBI e-mail advised you that your name check was pendin, USCIS is not the office you should inquire with. You should contact the FBI for them to look into your case, also while contacting your representative, you should advise them to contact the FBI on your behalf. My country of origin in Gabon. check this page and the second PDF file about who to contact at the FBI. http://www.immigrationportal.com/showthread.php?t=136848&page=1&pp=15
Kalla, I guess you still waiting for that fbi check? man..this is really getting worse. Can you check your case status online and let me know what it said right now? My case is around 6 months after yours and I have this on my online status
" Your I485 Application to Register Permanent Residence or to Adjust Status was received at this office on February 20, 2004. It is taking between 120 and 180 days for us to process this kind of case. We will mail you a decision as soon as processing is complete."
I got my FP on August 2004 and half way through my second EAD. Now just waiting for the interview letter. Anything happens before you got your interview letter? like some change on your online case status?
Hi Andy, My online status has been showing the same message as yours for the longuest time, nothjing changed before or after the interview. The only difference in my msg being the date which is " October 2003".
I am just waiting now and every month I pay a courtesy visit to the District office through an Infopass appointment just to remind them that I am not dead yet!
Kalla, If you read the last post from Wendy at http://immigrate2us.net/forum/viewtopic.php?t=265 you will see that apparently, the online status should change to finger print received after you got your FP.
That person got the stamp on the passport and the real card on Aug 2004 even she applied in 5/2003.
Hi Kalla, Sorry to hear that your green card situation is as slow as mine. Anyway hopefully someone will soon look in to our files (that is all we can expect). Anyway thank you for link of who to contact in the FBI. Have you contacted Mr William Hooton? Any response yet? Let me know. Yeah in Feb we will contact our senator or congressman (who ever is free to look at my case). Anyway this month I am concentrating on FBI Sending FOIPA and making some calls and faxes before going to the Congressman/Senator so if I don't get any answers then I can tell them who to contact at the FBI. Once I get a lawyer then I am filing for a advance parole so at least I can visit India in Sept of this year. Thank you so much for your response man appreciate it. Let me know.
I've been following your postings and have relpied to previous ones. Here is a recap of my status. Receipt date: 9/03 First Finger print: ?/03 AOS interview: 3/04 I've been waiting for name check for 8 months. Got second finger print letter yesterday. Scheduled for feb 5th. Not sure if it means my case is moving but at least it's something. I will follow up with FBI fp department since they are reachable via phone. Will keep you updated.
I have no idea. They say FP are valid for 15 months or so. I guess it has passed that time so... No one at BCIS gives clear answer on what is going on and why. Even my lawyer can't get anything out of them.
Cafrine, Did you sent your AOS on 9/03. When you wrote Receipt date 9/03, did you meant that the date your local INS received it? Where is your location? Not in NYC right? Cause i sent in 03/03 but has not heard anything regarding the interview
9/03 is BCIS receipt date. I filed married based AOS to US citizen in san Francisco.
A friend of mine filed on 10/03 in Miami, she just had her interview on jan 4, 2005 and was granted permanent residency that same day. She received her GC in the mail 2 10 days later.
We filed for my mother-in-law in 9/04 and just received interview letter for feb 15, 2005. She will probably get her stamp has she is over 60 years old.
Which is to say, nothing makes sense. I'm still sitting here waiting!
Hello, I've got GREAT NEWS! I got "the letter" this saturday stating that I was granted permanent residency. My worries are finally over and I will be able to travel. Courage to those of you who are still awaiting their name check. It will come through, It will come through....!

The letter said that I was granted permanent resident status as of Feb 10th. That the letter is not proof of residency. That i would receive the card in a few weeks but If i need to travel i should go get my passport stamped. Which I'm going to do soon.
Also I wanted to add. I just received an email from FBI today Feb 16th in response to an email I sent oct 27, 2004 regarding my name check. It says that they received the request name check from BCIS on Dec. 2004 and cleared my name on Jan 18, 2005. I'm upset that BCIS took so long to send the request. They were supposed to do so right after my interview in march 2004.
So for those of you who are waiting. I know it's difficult to get details from BCIS, but you should request that they tell you when they sent the request to FBI.
The only way to contact FBi name check department is via email. Note that they are 4 months behind in responding to emails you can give it a try at FBINNCP@ic.fbi.gov.I thank you for following up with my request. Also I would advise that you contact your BCIS office to make sure that they have sent out a request to FBI. If you can make an appointment to meet with an immigration officer. Ask for the specific date when the name check request was sent to FBI.
Here is what I wrote:
"Dear Sir, Madam,
I have applied to the Bureau of Citizenship and Immigration Services (BCIS) for adjustement of status through mariage to Us citizen. My husband and I were interviewed in April 2004 and were told that our file would be sent to the FBI for name and background check. BCIS claims that they have not received any clearance to this date. This is why I am contacting your office in hope that you might be able to update us on the processing of our file. Please let us know if our file was received by your services. Below is my information to unable to retrieve my file.
