I have entered USA on H1 at 1999. In October 2000 my employer filed LAbor Certification on my behave for Green Card process. I have changed employer and new employer filed another LCA for me in July 2001. Aplication from first employer was withdrown. Now I have LCA from my current employer approved. It happened, that I overstayed my latest I-94 more then 6 months, but my I-797 is still valid for a few months. Can I file I-140 and I-485 under these circumstances using 245i? Thanks.
