upon adjudication of your i-485 you will be sworn in to tell the truth and they will ask you again what is written on print: where you arrested of any crime? answer NO. they will get a clearance after the interview from the FBI. If your estafa case is on their file they will say you committed perjury. if you can get a tape recorder inside the room to tape the interview. this will be evidence that you only answered this specific question and nothing more, in case a problem arise re your PI problem. i doubt that it will. did you ever pay what you owe in the PI? i hope you did.

Okay, I understand your response. HOWEVER, why would I tell them about an 'immigration process' here in the States when there really is none. If I say that, they will naturally ask me at what stage the process is. My point here, which may sounds moronic, is to 'avoid' (if possible) telling them that I'm already out of status here in the States. BUT, that I need for them to 'sponsor' me for a work permit or temporary resident (whatever eklat!) Hope you understand what I'm trying to drive at. And thanks a lot again.

I sent a relative to pay but the person holding my check is in hiding right now.Actually I don't owe anybody any money.she begged me to borrow a blank check with my signature in it so she can present it to her supplier like a post dated check so she can get some supplies for 30 days. She promised me she will deposit something before the time comes but she never did. I was in a very bad predicament because I never thought she wrote down 40.000 pesos.She used to be my childhood friend and I trusted her my life, never in my imagination she will do that to me.I can't even afford to pay a lawyer at that time.Looking back if I fought my case I could have won but I was so naive at that time.I am planning to hire a lawyer in the PI to assist me drop this case .Anymore input will be very much appreciated. you really need to hire an attorney specializing in canadian immigration. there should be loopholes somewhere in there. you may not want to lie but you are already in a situation of deception. maybe you can just repost and wait until somebody answers. best wishes.

you need to settle the case in the PI. Hire a Philippine lawyer and get the case cleared. once clear, secure the case proceeding and judgements for proof if any problem with the INS arises. Of course you should do this before you get interviewed.

I AM definitely seeing a lawyer but posted here to get some feedback - maybe someone was in a similar situation and could shed some light on my issue.
Much as I truly appreciate your replies, none of them helped. First off, YOU were the one who suggested I lie AGAIN to my prospective employer regarding an 'immigration process' here in the States. And then to respond that I am "already in a situation of deception" does not mean I should go that route again. Kaya nga I'm trying to get legal the legal way, eh!
But thanks for the replies. It is best though if suggestions are more practical than advice that constitutes yet another possible problem in the future.

i am thinking of what is the best move for you. you are already lying and you cannot work out of this with anything else except the truth. But the truth means accepting punishment or consequences. so its either you gamble and tell your prospective canadian employer about your true status or lie to cover up your present state. Telling the canadians about the truth and them dealing with you inspite of this is like getting a fresh start. A start where everything is honest and right. If you dont want to tell them the truth, your only recourse is to lie again. Telling the truth or lying are the only choice. if you tell them the truth at ayaw nila, at least you are stil here sa US. If you lie about it, you have to live with it until you get your landing papers in canada. I gave you the "lie"advice. now im giving you the "truth" advice. Mamili ka iha. Good luck.

you have to update yourself on Philippine-US relationship. There is an extradition treaty between the US and the Philippines. In fact one of the Philippine senators (mark Jimenez) has been processed for extradition to the US since the US govt filed for it concerning illegal contribution to cinton party, tax evasion, and fraud. He is in florida right now in jail. A wanted gambling lord (atong ang) is presently under US marshal custody and is fighting extradition back to the Philippines.
