All the legal opinions in the world will not matter till the INS is willing to act on them.
The best thing is to wait till the INS comes out with the new regulations regarding Public Law 107-208 ( CSPA ). No consulate will issue a single visa till they know how to interpret the law. So let us be patient.

I have a question related to the new CSPA: my brother's wife was sponsored as a religious worker. The petition was approved in 1998 but adjustment of status took a long time. She finally got her green card in February 2002. Her son turned 21 last year so he did not get his green card. The INS lost her husband's (my brother) file and only recently found it so he has his green card interview in November. Can their son who is now 22 get his green card with his father in November? If anyone has an answer or any suggestion, I would like to hear them. Thanks.

getting a lawyer may be is not a good idea this time. without the INS guidelines, the lawyer you may hire is as confuse as we are. rules and regulations by administrative agencies are gernerally retroactive, it means said rules and regulations will take effect back to day one of the law's effectivity. the cspa still has to take effect on 8-6-02 even if said rules are promulagated 2 or 5 months or yeasrs later,
i WAS TOLD the INS has not manifested a good track of record in formulating rules sooner, may be for lack of manpower or what, I do not know.
Let us wait, if you are in US, I suggest you write your congressman, senator or the INS to so that they act as early as possible.

CSPA is the Child Status Protection Act
Children who turned 21 before their petitions were adjudicated were treated unfairly because of INS and consular processing delays.
They were left behind.
President Bush signed the act in August. He wanted them protected. Now, they back date the child's age to when the petition was filed, instead of when it is adjudicated.
It's why they call it an "age out" protection sometimes.
