An application for benefits of the CSS and LULAC settlements was made by a relative of mine.
He was a CSS class member. He applied on July 2005, 1-687 and I-765. He received Receipt on July 27, 2005 for both I=687 and I-765. He then received Biometrics Appt. for I-765 about a month after. Appt. for Sept. 27, 2005. I-765 Approved on Oct. 04, 2005 and card received 4 days later. Early May 2006, received Appt. for Code 3 Biometrics for I-687. Appt. for May 30, 2006. Biometrics taken May 30, 2006. Status Unchanged since July 27, 2005.
As of today there has been Activity on the Case these past two days, but no change of status.
My question now would be, Can you CSS/LULAC applicants post your time lines so I can compare the steps involved in the process.
I have a pretty good idea about the steps, but I want to know how these steps are implemented in real cases.
Well, it looks like the USCIS is finally moving these cases.
People from all over the states are receiving their I-687 biometrics appointments. (I know these by following different forums)
I wonder if attorney Peter Schey had anything to do with it. I know he said he was going to talk to the court judge that handled the settlement about the USCIS taking too long to work on these cases.
Yes, I'm going by what the Online Case Status shows. So I'm usually on top of any changes USCIS, funny thing is that biometric appt's and those type of things do not change the status of the case online, since the Letter for the appointment caught us by surprise when we got it in the mail.
Freedom1, if you will be so kind to let me know what other forums other CSS/LULAC applicants post, it would be great.. Thanks.
taxreg16, No, there was never a LIFE application since from the beginning it seemed they wanted impossible amounts of evidence, plus being a CSS applicant the LIFE application would of most likely gotten denied because of the brief absences during the filing period. LIFE would of been an option, but the New Settlement offered a more direct and logical path.
Plus the Family Benefits through this New Settlement for a CSS applicant atleast were great so we'll be holding our breath to see what happens now that the Code 3 FP have been done.
I couple of weeks ago, CIS was moving forward those cases. CIS sent a lot of I-687 biometric appointments. According to the legal settlement, they have 12 months to adjucate these cases, if not, then they are breaching the agreement. So maybe out of the sudden somebody got appointed (internally at CIS) to work on these cases?
One can only hope.

To Freedom1; Do you know or anybody else after how long (time frame) from I-687 interview with CIS they have to inform the applicant of his approval or denial or if they need more evidence? Thanks
I don't know about those time frames since each case is handled differently.
What did they tell you on the interview? The interviewer has the power to approve the application on the spot. What was the reason for them not to do so?
Like Freedom1 said, each case is different, but I have yet to see any CSS LULAC applicant from the May 2004 to Dec 2005 settlement approved or been schedule for an interview.. Like my father, only for biometrics.
In the interview the immigration officer told me I’ll hear from them within a month, but it’s not true I did not hear anything after two months. I meet four people in the waiting room and I talk to them after the interview and no body got approved.
Freedom1 did you had your css/lulac interview and what is the out come, how about your Life Act case? Any css/lulac applicant feebback welcome
I sent my LULAC application end of last year before the deadline, initial denial b/c my attorney did not send any real evidence. So we then got a RFE and sent that back Feb 17, that was recieved on the 25th. That was the I-687. Initially on the paper and online receipt it said this case will not take more than 60 days etc. because of preprocessing but then they changed it to you can look at the current processing times statement, although there is not current processing time for I-687.
Anyway we sent both I-687 and I-690, I recieved the receipt for the I-690 with a date of March 28, 06 even though they received it with the I-687 in Feb. The current processing date for the I-690 is March 08, 06. I was checking my online status yest and saw that the I-687 was worked on June 17, 06 and the I-690 June 19, 06 which supports what other people are experiencing that the INS seems to be working on these cases albeit slowly.
I live in NJ, but my file is currently at the Missouri service center. Does anyone know if traveling with an AP either one based on the LULAC settlement or on the LIFE ACT is dangerous?
I haven't traveled abroad in my life and really would like to do so.
Will keep you posted as to the progress of my case.
Its not good to travel right now,If your case is deney while your are travelling outside and will be deney to get in. Should advice any immgration lawer before travel.
I am a CSS applicant. Does anyone know whether the renewal of EAD is free or you have to pay? I sent in my renewal last month without the filing fee, because according to the settlement agreement, the first renew is supposed to be free. They rejected it, because of no filing fee. I went to USCIS, with the printout from their own website about the settlement agreement, they still asked me to send it in with the a filing fee. Anyways, anyone with or same predicament or ideas? Please respond? Bern
