Need advice, pls. Lulac case was denied on july 17th, mailed the decision on july19th,07. Rec'd it on the july, 23rd,07. Apealed against the decision was sent out on the 10th Aug,07 with old fee which was on the form ie. $110.00. USCIS rec'd it on the Aug 13th,07. They rejected it due to incorrect fee and send it back on the 17th Aug,07. And stated need to resubmit appeal with appropriate fee and also they posted all the paperwork originally sent with a postmark date of Aug 13th, 07 on each paper on the side under Newman Case. Rec'd in on 21st Aug,07 and then resended it by next day overnight on 22nd August which they rec'd. on 23rd Aug,07. Now, yesterday rec'd a letter from them stating appeal rejected as not filed in time. This is so harsh, we already have been waiting for 27 years for our cases. Now, they are not giving us a chance for just missing probably by a day.The first pkg. was sent out in time. Pls. Advise.Need ur help.

Thanks for responding back. I am a lulac member since 1991. Our case has been dragging since then. I also applied in life act, which was withdrawn as were told by the ins officer no chance due to missing original federal kind of docs. Was told have a better chance in the approved settlement case of lulac/css. But, still their behavior remain the same , no issue.According to the settlement of lulac, the members should be paying different amount of fees alongwith the ins. should be paying half too. But i guess they have changed all the rules according to their convenince. As always, their mind is preset not to give any chance to issue. Now, they took my $545.00 and sent a letter that its being rejected as not filed in time. But, the original appeal was sent in time with the wrong fee. I am sending a letter to reconcider my case. Lets see wht happens.

You have a few problems.

1. A motion to reconsider must be filed within 30 days of the adverse decision.

2. I-687 cases are not subject to motions to reconsider.

3. Unlike all other Government agencies, the USCIS is not accountable and has a very cavalier disposition. They literally have the power of God over the non US citizen, and sometimes use that power in unfair and cruel ways.

4. Unfortunately there are tens of millions of illegal aliens running amuck in the US. The CIS cannot find and deport the undocumented ones. So they bully and deport many of the good taxpayers who are following the law and are trying to adjust their status legally. Your fate with the USCIS depends more on whether or not the Officer likes you, rather than your qualifications. This is because unlike any other dispute in America, there is no judge.

5. The next letter you will get is a notice to appear. That's if your lucky. If your unlucky, ICE will break into your home and arrest you.



The only thing un-American about America, is the USCIS.

Unique, you are absolutely right. The USCIS is a ruthless agency not accountable for their action. Lazy and arrogant employees, as one lawyer told me he never heard any immigration officer fired for his mistakes or performance.

Any update concerning your own case.
I heard there will be a new late settlements coming soon from Washington western court district, may be some other css/lulac member can update us about it.

To Pearl what was the reason the USCIS denied your css/lulac case? How did you enter the U.S (first, second time) what kind of doucuments you have from 1982-87.

my css aao was denied on aug07, and it sent back to local office and they will make a decision within two month.really its very scary now.

what is lulac case means?oh oh $110 for the appeal and it got regected?hmm,,,sound scary ,,bcoz i just sent the appeal form for the denial of my i-130 and its $110 also...this is what i dont understand,,thoes idiots sends letters with the amount of the money and when u send it they denied it bcoz its not the right amount..wellll,,who's fault is it?

Try sending your case to the
cis ombudsman be sure to provide them wiht proof of your orginal appeal filing date and case information.

and their form located at
www.dhs.gov/cisombudsman

Can the Ombudsman Provide Legal Advice?
CIS Ombudsman cannot:

Adjudicate immigration applications or petitions;
Reverse an adverse decision issued by USCIS;
Serve as a substitute for legal options available to you to correct a problem; or
Provide legal advice.
NOTE: CIS Ombudsman only has jurisdiction to provide assistance resolving case problems that arise under the jurisdiction of USCIS. The Ombudsman is not able to provide assistance with case problems that arise under the jurisdiction of other agencies dealing with immigration-related issues, such as:

The Immigration Courts and the Board of Immigration Appeals (BIA), which are part of the Executive Office of Immigration Review (EOIR);
The Department of Justice (DOJ);
Customs and Border Protection (CBP);
Immigration and Customs Enforcement (ICE);
Department of State (DOS), including the National Visa Center (NVC) and U.S. Embassies and Consulates; or
Department of Labor (DOL).
