Generally, the I134 is used at the consulate level for visa petitions, and the I864 for adjustment of status to permanent residence. I say 'generally' because there are some consulates that require the more legally binding I864.

For the adjustment of status, the Affidavit of Support form I864 is used. The principal sponsor, the USC spouse, fills out the I864 with his/her income information. If the sponsored immigrant has been a member of the household for a period of 6 months, he/she can include his/her income and enter the combined income in Part 4 of the form.

umm..****! We've been married less than 6 months and she was going to school, so she wasn't making too much money (the lovely live of students). Let me pose this new question: if her income is under 16000 BUT other property (car, savings, life insurance, etc) will put her over 16,000 do you think we'll be alright?
