3 years ago a friend I met on the internet came to visit me in the USA on the visa wavier program from Germany. He had no intention on overstaying, but did to help me and my children through a difficult time. It's now been three years (we recently got married)....what do we do next?

If you are US citizen, he should submit papers for adjustment of status (I-130, I-485.. ) Read more about it at http://uscis.gov/graphics/howdoi/LPRApplication.htm

Good luck

@ aneri - Thank you very much for your help.

@ Someone12 - I understand how you could think that, but please don't be so quick to judge. Situations came around that lead to an overstay that lengthy and I'm sure no one here wants all of the details.

Best,

tann

BS....what, was this person handcuffed to a wall for 3 years? Were the airports closed for 3 years? Did this visa cheat develop 'amnesia' and forget where he was?
Sorry, but no matter how you try to sugarcoat it, irresponsibility is still irresponsibility, and illegal employment is still illegal employment...and it is tiresome to hear all the phony rationalizations for violating our laws from the whining supporters of visa cheats and border jumpers....of course, this category of individual is just as irresponsible and unpatriotic as their illegal significant (or insignificant) other.

mikemeziou & a12345 are a pair of idiots....first, mikemeziou, you are not even a citizen of my country; you are just a visa cheat dirtbag, like your whole family.
America has laws, you morons, to be obeyed, not ignored. These stories of "unplanned" overstays are as much bs as your phony story that you and your cow 'forgot' she was pregnant...and you still haven't answered, Mr. Big Businessman, as to whether you paid the hospital bill.
As far as unauthorized employment, no adult from another country can stay in the US without working - and this farfegnuggen dumkopf was, at the very least, providing child care and housecleaning chores, which are considered work (at least by anyone with an IQ above 80, which means both mikemeziou and a12345 are left out of the picture)...

Housecleaning and child care may be considered work for some, but unless tann's German friend took a position that tann had otherwise been paying for, I'd be inclined to think you may be stretching the point to make your argument. There's nothing inherently wrong with a visitor from another country returning the occasional chore for the privilege of staying at someone's home ~ even as a tourist.

It is a violation of the Visa, try saying that is the purpose of your Visitor Visa and see how successful you are.

If someone overstays a visa waiver entry and are caught, they are immediately deported. They are not allowed an appeal.

It sure was lucky that kid from Germany suddenly remembered his trip to Canada!

How does that pertain to tann's situation? BTW, marriage to a USC forgives unauthorized work and unlawful presence at adjustment if alien was not EWI.

It pertains as a warning: they are not married yet. He is one traffic ticket away from getting a one-way ticket back to the fatherland.
