That is the 'new conventional' wisdom being tossed about. That these old white guys are somehow out of touch. But so far nothing has been given to adequately justify this claim.
To some extent judges should be disconnected from much of what is going on outside the court room. It keeps them from being subjected to the pressures of the daily shifting popular opinion. The focus should be on what is right as it applies to the laws written.
Life experience outside the realm of law and rulings should not be used in making decisions. By doing so clouds the application of law and allows bias to creep in. It is clear she would favor hispanics by referencing what ever characteristics she believes are unique to them in her rulings. And by her remarks would tend to put anyone white at a disadvantage with her apparent negative assumptions.
Justice is supposed to be blind. This is what the statement means. It references nothing but the law and gives no sway by other factors, race, or otherwise. She is clearly the wrong person by the mere mention of her nationality as any benefit to the position.

WASHINGTON (AP) — Former House speaker Newt Gingrich said Wednesday he should not have called Supreme Court nomineeSonia Sotomayor a racist, but said he was still concerned that she would bring bias to her decisions.
In a letter to supporters, the Georgia Republican said that his words had been "perhaps too strong and direct" last week when he called Sotomayor a reverse "racist," based on a 2001 speech in which she said one would hope the rulings of a "wise Latina" with a breadth of life experience would be better than those of a white male without similar experiences. Gingrich's remarks created a furor among Sotomayor's backers and caused problems for GOP figures who have been pushing to bring more diversity to the party.
Gingrich conceded that Sotomayor's rulings have "shown more caution and moderation" than her speeches and writings, but he said the 2001 comments "reveal a betrayal of a fundamental principle of the American system — that everyone is equal before the law."

She shouldn't have said what she said. Much like Newt letting it out loose and fast. But if you look at her actions over the years, it hasn't borne out that she's acted on her beliefs and ignored the law. That's the important thing.

I think she will. Questions were raised about John Roberts and Sam Alito and they got through. What's important is her record, and that's largely neutral.
