My friend brought a Russian lady to the States to marry this year. They had to marry on or before July 31st. Just a few days before the 31st she went to visit a Russian friend who had come to America a few years earlier. She was supposed to return on the 28th, but she didn't - she wrote to tell my friend that she didn't want to marry him. Now she has overstayed her visa. What should she do? Is there any way she can legally stay here? If she must return to Russia, will she be able to return if she chooses to?

Maybe marrying a USC might give her chance to be legalized in the process.She can go back to Russia anytime without problem.The only problem is it would take a while before she can come back since she has overstayed her visa and she is subject to 3/10 year bar.

If she came on a fiance visa, there isn't anything she can do. Even marrying another USC.

If she has not overstayed more than 179 days, she won't be subject to the ban, however Marie is right. Unfortuneatly, she has no other options if she came on a K1. She has to leave. She should depart as soon as possible to avoid future problems. Good luck to her.
