i just got from the USCIS office in NYC where i was told that my name check was cleared!! heeeeha! finally, after 15 months!!i know a lot still have this problem and i have this advice for you: advocate FOR YOURSELVES! i wrote to the white house, FBI, USCIS, my congressman, my senators, UCLA, and many other governmental and non-governmental organization that deal with human rights issue (i consider it a human rights violation not to get a decision on a case based on some bureacratic ****!)..anyways, you have to annoy the **** out of them and wait for the responses. if you don't hear from them, do it again. my question to those whose name was cleared is: how long will take to get a decision on my case; hence, my oath appointment? i got a letter a couple of days ago advising me to get my second fingerprint on June 15. WIll it be a few weeks, months or what? thanks to all those who contritbute!
1) How do you know it took 15 months for the clerance? Did someone tell you when FBI name check was started or do you count from the time you filed all applications? When did you file?
2) Do you think all those letters you wrote helped? Why do you think that?
3) Did you write to CIS Ombudsman ?
I have been stock in FBI name check since 06/16/2006 (filing date). Almost a year now.
And answer to your question:
In my opinion from everything i have seen and heard you should get your plastic within few weeks after the fingerprints. Good Luck!

i am stuck since july 2006 and I sent to the senators but I do not know how to send or for whom to send at the white house, and I do not understand what UCLA is.

Tomek do you think that writing to CIS Ombudsman can help? or it is just a service to improve the USCIS procedures ? I mean do they review cases and pay attention to correct any situation if there is backlog somewhere?
I don't know how much writing CIS Ombudsman will help. I just wrote to them in April and i didn't get an answer from them yet. I know they received my letter and inquiry was initiated with UCSIS because they confirmed that with me by mail. I think they review cases and pay attention to details because they thank me for suggestions i made in my e-mails to them and also in letter.

Hi also a victim of this name check, i file in 2002, 1-485 interview 2006, still waiting for background check, anyhope for me? or its a never ending process.
you really are a victim, since 2002, it is really too much. I am in this dilemma since 2006 ( the date of sending my case t Washington DC) I cannot imagine what kind of process need that long time? I would understand that if they consider someone dangerous for any logic reason
we cannot just watch our misery and doing nothing we need to find a way writ of mandamus if possilbe will be the best solution to me.
Regarding your lawer question - i don't know how much lawer can help. My case is based on marriage and i filed everything with my wife. I never needed an attorney. I spoke to some immigration attorney here in NY but i am getting mixed opinions. It looks like the honest ones say that they cannot do much more then what we can do ourselves. If everything is ok with the case and its only stuck in FBI name check then they can only make an inquiry. That i can do myself.
I spoke to Immigration supervisor once and he told me that average waiting time for FBI name check is between one to two years. Very very few cases are beyond that time. I don't know how much of that is true but that's what he told me.
Also visit UCSIS web site under processing you will find expediate processing. Very few individuals qualify for it but see maybe something applies to you. I believe i qualify for "extreme emergent situation". I am in process of getting documents from my home country. I will let you know if it gets approved.

Esmor... I don't think you can get your passport the same day ... I think you have the mail your original naturalization certificate to passport office first or you can go to the passport office. USCIS does not have passport services within their facility.

Thanks Said Well my story is little different then all of you, it will need a lot of pages to write it but any way here is a summry *i got married in 2001 *file 1-485 in 2002 ok the story takes a turning point when they have the specail regstiation,well i went to do that(big mistake), got detain, because they said i donot have a waiver for my JI visa 212e. when i showed the officer the letter from state department that said i have applied for the waiver, he didnot care and said well u donot have it right now, so i was the offical guest of the USA government for 2 weeks, untill i got the bond, they wanted $50000 cash, (even Paris Hilton got away easier)anyway i paid $2500, and was out with court date for my deportation hearing,ok the funny thing is i got my waiver 2 weeks later (my luck).any way my country filed a legeal protest with DOJ about my detention and i was also interviewed by local Tv channel (my 15 minutes of fame) that it was not fair. ok so i have one court hearing, by the next court hearing i got call to INS for my I-130, me and my wife were interviewed , and my I-130 was approved(2004), after that they drop the case against me, and had myI-485 interview was done in FEB 2006,now they says its the name check ahhhh the never ending story(like my lawyer says they love me too much), but i am tired of that one sided love, hopefully one day my relationship with INS will be over, by the way i bet i have fingers prints taken so many time more then any of you(if there was a way i wish i could leave my fingers with them, so they donot have to ask me all the time ),as far as the name check my last name is so common good luck getting that cleared(by the way i always ask my self, if i have done anything wrong even in my dreams?why they are not getting it done? i am considering my last option the lawsuit. I know how you feel, can you apply for writ of mandamus? i mean take them to the court? or ask for your own fbi name check by contacting the fbi yourself? did you also try the congressman and the senators soultion? it might help.

Expediate processing - there are only 7 categories under which one could qualify for the expediate processing. I was referring to USCIS web site and where you can find all 7 reasons. Go to USCIS.com - then click on "my case is pending" on the left upper corner - then click on "USCIS Expediate criteria" link and you will see all 7 reasons - see if either one applies to you - see if you qualify. Most likely not but some people have "extreme emergency" at their home country or here and after providng proof to USCIS director there is a chance that your case could be resolved within 60 days instead of - "God knows how long".
You can call FBI on the phone and they will tell you when response to USCIS was sent but only on your "fingerprints" not your "FBI name check". They will not tell your results but will tell you when it was sent (it usually gets send within 24 hrs.) "FBI Name check" is what takes very long and no one will tell you where you are in the process and how much longer it will take.
There is a way you can get your FBI name check done yourself _ i think it takes about 6 months or so but to my knowledge UCSIC will not accept it from you. They have to get it from FBI.
