Please Help, I need some advise as I am receiving mixed messages.
I married a Pakistani, we have a 13 month old son together and have been living in Pakistan since March 2002. I was born and raised in the USA, filed the paperwork for my childs "Birth of U.S. Citizen Abroad" at the U.S. Consulate and it was granted. I left Pakistan in March of 2003 and went home to the US with the baby for 2 months to visit my father who was ill. I came back to Paksitan in June of 2003, went to the U.S. Embassy in Islamabad to file the 1-130 for my husband. At the embassy, the Pakistani man at the window told me that I have to file my 1-130 in the USA and cannot file it at the U.S Embassy. I waited and waited for a few hours to speak to an "immigration officer," who was another Pakistani, who told me that I can file at the U.S. Embassy there in Islamabad, but I have to wait another 5 months before I can file it, because I left Paksitan, and that I must stay in Pakistan for 6 months continuously before I am allowed to file at the U.S. Embassy. I told him I stayed in Pakistan for 12 months between March of 2002 and March of 2003 and he told me because I left, I have to wait here another 5 months before I can file at the U.S. Embassy.
I am hesitant to file in the USA because of the notorious increased waiting time, or is quicker now when filing in Texas? Or do I even have a choice? I want to file an application for a K3, spouse visa, but cannot get any answers from the U.S. Embassy, only that they have said that I have to file for the K3 from within the USA. On the State Department web site it says that I can file the K3 at the U.S. Embassy, but the Pakistani folks employed by the U.S. Embassy say that the K3 can only be filed from within the USA. Is this correct? Why am I getting such conflicting information? Is it because they are picking on Pakistanis post 9/11? Or does it apply to everyone all over the world? Which would be the quickest way to get this done? If I wait here for the five months and then file the 1-130 and do not file for a K3 if that is not allowed, can this still be done at the U.S. Embassy and would the immigrant visa be expedited quicker than filing in the USA for K3 and i-130?
Can anyone advise? I would GREATLY APPRECIATE ANY ADVICE....I don't want to file it, then have them reject it for some technicality, then with all the time lost and pain and suffering of the separation at hand! And...., thank you.
