Here's the scenario. A guy was previously deported from the US and is barred 10 years. He becomes a Canadian citizen with a Canadian passport. Can he cross the US border by making a brief visit to the US? All he needs is to show his Canadian passport, right? Will the border guard find out he was out of status in the US previously? What if he is caught? Will he be detained or asked to turn back to Canada?

This is one of the most frequently asked questions on this board.

You would need to know how the overstay and corresponding bar of former third country national affects one's ability to cross US-Canada border without visa as a Canadian Citizen now.

It's best to consult with US Immigration attorney who deals with Canadian Citizens immigrating to US.

I already got some answers even from lawyers. The 10-year bar stays even for Canadian citizens. They need to apply for waiver just like any other aliens. But here's the catch: If you are white or caucasian, you could sometimes get in without trouble. But if you're colored especially with a Middle Eastern look and name, you'll be checked further. This is especially true after 9/11. And it also depends on the mood of the US border guard. Inspection is done by random. If you're lucky you can pass by just showing your Canadian passport. Before 9/11, a Canadian driver license was suffice. How could the border guard check even traveler crossing the border? It's close to impossible. Worse comes to worst, you would be asked to turn back from the border entry. If the border agent is in a bad mood, he can detain you and initiate deportation proceeding. You would be in jail for a few days. And there are cases when the guy is deported back to his home country and not Canada even if he's already a Canadian.

Seriously, I would like to get the opinion from other people...not only from you 'cause you seem to have no answer for most questions. Give others the chance to respond, and I think you don't have the monopoly of this site. If you don't have the answer, don't answer!

Usually I reccomend people to consult professional immigration attorneys(did the same in your case) and state that I am not a practicing immigration attorney .

What I found odd in your case was that you asked a question knowing the answer beforehand (as demonstrated by your own posts above).
So, I naturally wondered - why would you ask the question that you already knew answer for? Confused

My main goal here , on this site, is to enlighten people, open their minds, improve their thinking ability so they can draw their heads out of their poopholes where they seem to permanently get stuck. Big Grin

And once people pull their heads out of their poopholes they will be able to get the answers to most questions they post here - sometimes it may even help them to discover that they knew the answer beforehand Big Grin

I don't know what your role here in this site is. You may be the moderator. You have so much time making me wonder if you're unemployed or some kind of a disabled *** at home.

Tell you what...you can answer why not even by just stating you don't know. But you've the habit of making side comments; making sarcastic remarks and try to insult people. Is this helping people?

Not that I already knew the answer. I had one but wanted to know the opinions of others.

You have a Canadian passport so you are a Canadian citizen. Have you committed any crime or are there any warrants for your arrest anywhere? Usually, this is the red flag at the border - they have the computer lists of wanted persons at every border.- Or if you have fruit or red meat you can be in big trouble.

You can still cross the border without a passport - just photo ID and aa Birth Certificate!

Is your friend just coming to the US to visit for a short time (he is allowed 6 months) or is he coming to stay?

I would guess that if the border crossing is busy enough, your friend would just show his passport and answer the questions with little problem. If, however, he is wanted for any crime, he should just stay home. They can turn anyone one away from the border for any reason.Personally, I would apply for the waiver just to be sure.

About Canadians crossing the border, the query was clear: He was previously deported from the US and is barred for 10 years. Being deported or out of status was not a crime if that was your definition in your reply. Can he cross the border showing his Canadian passport? I already shared what I knew earlier; but would be glad to hear from you and the others...except this antihuman.
