I am a *** native-born American and am attempting to get my Syrian partner into the country on an F-20 student visa. He was accepted at CUNY in its ESL program, and he was issued an I-20 plus all required paperwork. My sponsorship was accepted and he has extensive proof of continued ties to his country. (His family has financial assets -- would be considered upper middle class.)
However, the American Embassy did not even look at the paperwork when denying him in Jan. -- he was just told to come back in 6 mos. to a year.
In speaking with school reps, I was told that this is common procedure in many contries and the paperwork process will be repeated.
He will repeat the process in August. Is there anything I can do that will expediate or help the process?
there is nothing you can do...because if the embassy officials do not believe that he will return to Syria after his "studies" they will deny his visa application..over and over and over...and there is NO paper nor document that can change that....none....they have seen through your scam.....
how do you know they were not examined? Were you at the interview? (no)...and NO document guarantees an individual's return to their country after a visit or study...none....if you believe otherwise, which document do you believe, according to current US law, instantly overcomes the presumption of immigrant intent? Which one? That's right...there isn't one. And no doubt the consular official figured out that this student visa request is nothing more than a feeble attempt by both of you (you and your partner) to gain admission to my country and live here permanently...and no paper will dissuade the embassy folks from believing otherwise....but, if you doubt this, keep on producing whatever silly document you want...and I noticed you did not deny my guess that this whole student visa deal is just a scam...nothing more. The purpose of this discussion board is to discuss immigation issues/problems. You do not know anything about me or my partner -- our motives, our situation or sequence of events that led to seeking the student visa.

And you are wrong when you say that no documents can prove one will return to a country of origin. There are financial, family and rght of inheritance that is documented. The documents were not examinated so your specious arguments are moot.

so...find that document that is specifically mentioned in our laws that, in and of itself, overcomes the presumption of immigrant intent....I DEFY you to do so... and there is no such word as 'examinated'...which only proves that (a) you are an uneducated dufus and (b) you have no idea of whether or not certain documents were looked at since you were not at the interview...you were thousands of miles away.... the key issue here is 'intent' of the applicant...and no paper can prove intent... .but again, for the learning impaired...please...find that document that is mentioned in our immigration laws that says otherwise..... the scam is that your 'partner' is attempting to use the student visa to live in the US of A with you....and that is not the purpose of same. As far as inheritance goes, well, a person can inherit property or assets without having to be a resident in a certain country...so that argument is worth nothing. And I don't care one bit about your orientation nor your partner's...a lot of people try to use student visas to gain access to the US for other reasons....that's no surprise.

This is a non immigrant visa and it would appear from the above that there is a strong suggestion of immigrant intent. I am sure that is how the Consulate sees it.
He would be better of looking for a visa that allows dual intent, for example H1.

aside from these paper works you mentioned you and your friend should check on this...
Immigration will also check your friend financial capacity to pay for the whole course. Usually they ask for a bank statement .
5 years ago I think the min then is at least $40,000.Remember he will be considered an international student here in the US , he's only allowed to take full time course and I don't think he will qualify for a financial aid.

Someone12, I agree with about 95% of your posts, however not this time. You having an off day?? His partner is not currently in the country as per the post ("get my Syrian partner into the country"). If his partner applies for a student visa and gets it, that's great as long as he follows through and actually goes to school, and in the end does not overstay his "school visa". However, if he decides to stay (after his schooling) in the US and applies for, and receives some other visa or green card, then, also great. As long as he does everything legally, and keeps a legal presense in the country.
Their main objective may be to be able to be together, and if applying for a student visa is the way to do it, then great. As long as they follow through on the terms of the visa. He probably cannot apply for an H1B visa because he doesn't have a degree or the work experience. After getting his schooling, he may be able to apply for and receive an H1B. No one comes to the US with a green card in hand, everyone has to have some type of visa prior. If he applies for a school visa, gets it, and completes his schooling, then I see no lie or deceit there. An immigrant with an education would be a very good thing.
no, I am not having an 'off day' and I appreciate your support (few readers, I imagine, enjoy a 95% approval rating of my postings!!!)..but...note that the OP said 'how can I get my partner into the country' -- not, my partner wants to study English to improve his career in Syria (which would make no sense since English is not the pivotal language there)..nor did he say..my partner wants to study English to go to university in the US'..no, nothing of the sort...and when I challenged their motives, I got nothing as a response...ergo, I believe I am right....and, furthermore, a student visa, especially ESL, is supposed to go to those who intend to return to their country after studies, not to use it as a vehicle to immigrate to the US....and these two are trying to use the back door (oops, did I say that??)....

Just say that the OP wanted to find a way, so his partner could come here legally, but main reason was that they wanted to be together in same country, however studying was on the agenda too.
So what..in the OP's case there isn't much of a choice as same *** marriage or common law doesn't count for immigration purposes and most States are against it, so they could never go the relative route like most couples could.
OP I am not saying you are doing this or that you want to get married (just saying what if)
