I married my husband in June 2001 he is from Mexico and I was born in New ,York we are a older couple Felipoe is 49 and I am 47 it was love at 1st sight people call us Lucy and Ricky because we act just like them and we are inseparable and there is no one that can surpass our love for each other .We put all of my husbands paper work to the INS in 2002 and paid all the money for all the applications I-130 Immigrant Petition for Relative(June11.2002) INS told us it would take 175-225 Days to process the petition so we both knew we had time to save more money for what ever else came up meanwhile we where working hard thinking that our life was going to get better and our dreams would come true. But our nightmare was just about to begin I was not feeling so good so I made a appt with the DR to see what was wrong with me I get a call to come in to the office ASAP which I did when I got there I got the news of my life I had a death sentence put upon me I had Cancer my 1st thought of course what would happen to my 4 Daughters and what would happen to this Man that I have waited to be with all my life would I die and not watch my Daughters get married would I be able to grow old with this man that I love so much no one knew at this point but one thing I knew my Husband held me in his arms and told me not to worry because we had each other and we could get through this and nothing or nobody can take that away from us. I had the operation to remove the Cancer and of course my husband was right there to take care of me he feed me bathe me and carried me around like a baby because I was unable to walk .This Man that I call my husband is a Angel I was married to my 1st Husband and it was a marriage of abuse to myself and my 4 Daughters and when I finally find happiness and a Man that adores me and my Daughters my own country wants to take that away from me what happened to Life, Liberty, and the pursuit to happiness is it not my right as a American to be happy my Husband is not a criminal or a terrorist is only crime is that he is in Love with a American and now he is paying the price for it .On March 17,2004 we received a letter from INS that the (I-130) has been approved so we put in all the other paper work (Advance Parole) His Mother was very sick so he had to see her ASAP also his employment and any other paper that needed to be send. We had to move since I got the cancer because we where unable to afford the place that we where living in I send in the correct address change 11/2004 and it was noted .Felipe got approved for employment ,and advanced parole so we went to Mexico to see his Mother and came back no problem. Meanwhile we get a letter in the Mail saying that we missed a appt for 9/15/2005 I said to myself this can not be happening that the INS send the letter to the wrong address our government could not make such a big mistake so I made a appt with INFO PASS in Miami to see what was going on with our case ? The INS Officer told us that it was there fault I said to her that's a 1st that they would admit to a mistake and she said she would have the Miami office reschedule a new appt.We received a letter that we had a appt in the Miami office on April 3rd 2006 to appear for initial interview we went to the interview and I really did not have a good feeling about it the INS Officer did not even introduce her self to us she ask us all kinds of questions and all for the paper work which of course I gave her but then the question of the day came up how did my Husband come into the country I told her with out inspection with that she jumped out of her chair and said she would be back she took a while to get back to us and when she did she said there is nothing she could do for us. I told her my Husband left the USA and came back in the USA with a Pardon she said it did not matter and the only person that could help us was the President by this time I was crying like I have never cried before not even when I found out that I had Cancer.Well a about 1 month pass by and we get a letter from the INS that my Husband case was revoked but not for the reason she told us this was a new excuse because now they say we are not legally married I just stood there and could not belive what I was reading they said that my Husbands petition was a error I said what games are they playing with me now they said that the dates do not match on our divorce papers but I can appeal which I did and send them all the divorce papers again that was 5/29/06 meanwhile I wrote a letter to President Bush asking for his help I did not know what I was thinking I knew he would not help me I get a letter from the White House saying they are sending all the paper work to the UCIS and on 10/6/06 I get a letter from the UCIS saying that they contacted the Miami office and I should hear something from them in 30 days and I am still waiting I have not heard anything from anyone one no one can find my case at all when I call the customer service they only can tell me that the AAO send the case back to Miami in 12/06 also I get a email dated 6 /10/06 that my application to register permanent residence is undeliverable the only thing that I could do is cry because they keep making all these mistakes and my husband and myself keep paying for them .I finally said enough is enough I need to know what is going on again so on 8/22/07 I called the customer service they had no answers for me and told me that the Miami office would get in touch with me they send me a letter saying they are actively processing the case and have no answers for me and I have to wait another 6 monthes that means I have waited almost 2 years for a answer all my husband wants now is his employment card and a travel document so he can go see his Son in Mexico who was in a fatal car crash and some peace of mind which we do not have since this whole mess started It has been a long road for the both of us me very sick and my Husband trying his hardest to support us since I can not work and now I have to seek Psychiatric services and I go see a Therapist 1 a week because I think at any time they will come and take my Husband away .All my Husband and I want is to grow old with each other and live happy in peace and harmony. My Husband is my whole life and support and with out him I am nothing .I need help in finding out whai I should do.

That's something you might want to ponder.

Barbie4 - you need to break your post into paragraphs! This was very hard on the eyes. Good luck to you, just the same.

Barbie4,

you have several issues to address. Since your case is highly unusual, I don't think you can get here more than just guessing and some opinions.

I say "highly unusual" because, as you say, White House got invloved. Maybe that was a blessing... because, if your petition was the first one filed on your husbands behalf, (nobody petitioned him before April 31 2001), he would not be eligible to adjust status in the USA. He would have to go to Mexico to get his immigrant visa. And that means a new set of problems.

It was a mistake to use Advance Parole. Didn't you read the document? When one enters the USA on AP, person is parolled into the USA, not admitted as others. "Paroled" means let in with the conditions (will be "admitted" when status is adjusted) and that person is seen (in the eyes of the law) like still standing on the border waiting for a decision.

USCIS works in its own pace. Nothing much to do about it. You may try to get your Senator involved.

All the best to you and your family
